I'm not sure they could get this passed... DOT uses ine interstate commerce clause to levy requirements... if the tractors and for hire trucks are not involved in interstate commerce it would have to be implemented on a state byu state basis... just my read... YMMV
WD, this doesn't need to be voted on. This is a regulation. The department just makes a new rule with implementation timeline, fees and fines and ShaZam! Hell, they don't even need to make public input into the matter easy. Yep, all these alphabet soup departments and agencies are killing our freedom and our country. While you are correct in that it is a regulation.... DOT can only regulate interstate commerce... the regulations can only apply to vehicles in interstate commerce... Other regulations have to be accomplished at Satte level... Admittedly they can probably force states to agree with revenue issues but it would be a state descision...
I really hate to tell you (mainly because I hate that it is true), but the Supreme Court ruled in 1942 that citizens need not be involved in interstate commerce for their activities in order to affect interstate commerce, and therefore to be "involved" in interstate commerce. 1995 US vs Lopez (United States v. Lopez - Wikipedia, the free encyclopedia) found that Wickard vs. Filburn.. over reached and has since been used as the major finding agains Obama care... Of course anything can happen in a politically active court system... buty i'd place my money on it being found illegal under the commerce clause .... YMMV
They claim that they can regulate under the interstate commerce clause if any part crossed a state line. That is how they get by with their firearms regulations.
