    Hawaii could be first to put gun owners in federal database

    "HONOLULU (AP) — Hawaii could become the first state in the United States to enter gun owners into an FBI database that will automatically notify police if an island resident is arrested anywhere else in the country.

    Most people entered in the "Rap Back" database elsewhere in the U.S. are those in "positions of trust," such as school teachers and bus drivers, said Stephen Fischer of the FBI's Criminal Justice Information Services Division. Hawaii could be the first state to add gun owners.

    "I don't like the idea of us being entered into a database. It basically tells us that they know where the guns are, they can go grab them" said Jerry Ilo, a firearm and hunting instructor for the state. "We get the feeling that Big Brother is watching us."

    Supporters say the law would make Hawaii a leader in safe gun laws. Allison Anderman, a staff attorney at the Law Center to Prevent Gun Violence, said the bill was "groundbreaking," and that she hadn't heard of other states introducing similar measures.

    Sen. Will Espero, who introduced the bill, and the Honolulu Police Department said Hawaii could serve as a model for other states if it becomes the first to enact the law.

    Yet others say gun owners shouldn't have to be entered in a database to practice a constitutional right.

    "You're curtailing that right by requiring that a name be entered into a database without doing anything wrong," said Kenneth Lawson, faculty at the University of Hawaii's William S. Richardson School of Law.

    Legal experts say the bill could face challenges, but would probably hold up in court. Recent Supreme Court rulings have clarified states' ability to regulate gun sales, said David Levine, a law professor at the University of California, Hastings College of the Law.

    The bill will undergo a legal review process by departments including the Attorney General's Office, which supported the bill, before Gov. David Ige decides if he will sign it into law, said Cindy McMillan, a spokeswoman for the governor.

    The cost to enter names in the database will be covered by a fee paid by gun owners, which wasn't defined in the bill.

    Even though other states don't enter gun owners in the database, Honolulu Police Department Maj. Richard Robinson said it will still benefit Hawaii police. Right now, Hawaii gun owners undergo a background check only when they register a gun, so police have no way of knowing if they're disqualified from owning a gun in the future unless they try to register a new firearm.

    "We were only discovering things by accident," said Robinson, who helped draft the bill. "They happen to come register another firearm, we run another background check, and then we find out they're a prohibited person."

    That happens about 20 times each year, he said.

    Some local gun owners say the law confirms their fear that the government would know exactly who and where people keep their firearms.

    "This is an extremely dangerous bill. Exercising a constitutional right is not inherently suspicious," said Amy Hunter for the National Rifle Association. "Hawaii will now be treating firearms as suspect and subject to constant monitoring.""​

    This has a bad smell and doesn't pass the BS Test, as usual the innocent pay the price for the "20 bad" each year.

    all gun owners are irresponsible. That why there are 90 Million accidental and not accidental shooting incidents.
    Only the ones that have evil in their hearts will not want to give up their guns willingly and that is good enough reason to make examples out of them.

    We should be more civilized like Australia and the UK and only kill each other with knives and hammers.

    There is a federal law that prohibits keeping records of gun owners. They are required to destroy the background check information after so much time. As far as I know this law hasn't been repealed.

    That Federal Statute only prohibits the Federal a Government from keeping the Database, not a State Government from entering Data into a Federal Database... Two different things, legally...

    I was active duty military in Hawaii in 1976-1978. I bought a pistol that struck my fancy in a gunshop. I had a residence to keep my firearm at off base and a place to legally shoot. By State law at that time, before taking possession, I had to register the gun by make model caliber and serial # in my name, and where the gun would be stored, and have the purchase approved. It was the law at the time. This was not for concealed carry. In fact I was given a handout on how to legally transport said pistol to and from the range.

    In Michigan all handguns are required to be registered with the state police by sending a copy of the registration to your local police department.

    So yep. If you live in the Mitten, own a handgun. You are on a list.

    I'll hazard a guess that a federal agency could get access to the MSP Handgun Registry DB.

    If they did they would be in violation of the Federal Statute.... They can ask the State to search those Records but they CAN NOT, add those Records to any Federal Database... Knowingly...

    could they access and search the records and then tick a box that says .. handguns on premise in their database?

    If they got caught doing it, and maintaining that Record, in A Federal DataBase, then they would be in Violation of the Federal Statute... Many think they already are, behind the scenes... Now... And it only takes one WhistleBlower, to spill the Beans.... Just like "Fasr &Furious"...

    Yes, it's a federal law. That state has had the worst gun laws for a long time. Also, I do think the federal law does cover states as far as the background check records go. It doesn't stop states from registering guns.

    We've had gun registration for decades in a way because the ATF and I guess any law enforcement agency can go into gun shops and look at their records. Also, when a gun shop goes out of business, their records must be given to the ATF.

    Actually, No, a State or local LEO, can NOT just walk into a Gun Shop (FFL) and demand acress to the Bound Book or ATF Form 4473s on file.... If the State REQUIRES it's own Record Keeping, such a Wasington States Handgun Records, then those can be accessed, but NOT The FEDERAL Records, without a Valid Warrant... Also a State or local LEO who removes a FireArm, from the Possession of an FFL, even for an INSTANT, commits a Fedeal Felony, if that weapon is part of his Inventory... And listed in his BoundBook... This is EXACTLY WHY all my FireArms are listed, and Inventory, of my FFL.... There are NO EXEMPTIONS, in the GCA of 1968 as amended for State or local LEOs... Only a US Marshal, or an ATF Agent with a Warrant, can legally seize an Inventoried Weapon... Most State and local LEOs are not cognoscent of this fact... If such a case ever came up, with me, I would comply with their order, AFTER informing them of the Federal Statute, and then I would be contacting ATF, and the local US Attorney, and be demanding that the LEO be prosecuted, for the Federal Felony Violation... It is a case of "Ignorance of the Law, is NOT an excuse, OR a defense"....

    THe FBI estimates over 200 million guns owned in America not including law enforcement or museums. death by guns is approximately 12,015

    Cars owned in america 260m cars in 2014 and deaths by car accident 32,000

    but we don't talk about car deaths nearly as much as gun incidents... wonder why?[sarc2]

    I'm not a gun dealer, and you know more about it than I do. I'm pretty sure the records go the the ATF when the shop closes down and they can check the records before that. They recently settled a case with a gun manufacturer that was caught with unregistered full auto parts at the factory. Someone from the ATF had to have inspected the factory to find them.

    There was that young guy who was accused of shooting at people on a highway some time back. They just let him go because the judge finally found out bullets fired from his rifle didn't match any of the bullets recovered. It looked like the cops kept that from the judge. Anyway, they supposedly got a rifle the accused had hocked at a pawn shop and claimed that was the rifle used. They must have gotten a warrant. The accused said his rifle had been at the pawn shop during the shootings.

    Warrants are not difficult to get. There have been accusations of federal cops having blank warrants signed by a judge.

    Maybe because time has proved that you cannot design a safe car,meaning zero deaths.
    Thus the cause of most car death is a poor operator.
    Which from your numbers indicates that Gun Owners are safer than Car Owners.

    Yup, I was stationed at K-Bay 79-82 and can confirm what you stated.

    Of course since the NRA began the push to loosen up concealed carry permitting, registration has become a moot point as literally millions have gleefully registered themselves in exchange for government permission to hide their guns in their pants.
