This law was written in 1952. It was passed by a Democrat Controlled Congress, House and Senate, and signed by a Democrat president. "Suspension of entry or imposition of restrictions by president. Whenever the president finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, the president may, by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or non-immigrants or impose on the entry of aliens any restrictions he may deem to be appropriate." A quick read of 8 USC 1182 does NOT show that clause. (Doesn't mean it isn't there, just that I didn't find it. Possibly has been amended out.) Please point us to it. Carter's ban was based on nation of origin, not religion. The 1st Amendment of the Constitution specifically prohibits the government from discriminating based on religion...and that applies to anyone the government does business with. I'd hope Trump would be smart enough to accomplish his goal without overtly discriminating against a religion and creating an unnecessary constitutional controversy. Our current President and his anointed successor candidate both ignore the Constitution...if Trump wants my vote he needs to show that he respects the document and its principles better than they do.
Although many might sympathise with Drumpf's anti Muslim rhetoric, throwing overboard and circumventing the Religious Free Exercise and Establishment Clauses of the First amendment, and the Equal Protection Clause of the 14th amendment, would be a slippery slope to discriminating against people of other faiths and ethnic origins. Such executive actions would in any case be struck down by SCOTUS as unconstitutional, and would distract unnecessarily from the urgently needed reforms that may have some chance of actually helping to get the USA out of the dire straits that it presently finds itself in. I would be fascinated to discover what Presidential pardons a Drumpf administration might dole out....I suspect that the balance may tip more in favour of corporate white collar criminals, and away from 3 time drug losers from the 'hood.
Simply ban from specific countries . Like Carter did. Only ban from all of the ones spewing terrorists.
