OK, I'm going to come into possession of 3 rifles, to either buy 1 or 2 of, or resell all or part. 1. I could probably go through my LGS to access NCIC serial numbers, but what if they show up hot? Is there another reliable source? 2. And what's the going price, Gunbroker doesn't seem to have access to historical sold prices so what they show as asking prices are all over the place, and bid prices are few. 3. They are: Marlin Model 1895SS, with Leupold Rifleman 2-7X33 scope, and sling Marlin Model 336W, with Tasco World Class scope, no sling Winchester Model 94AE, no scope, no sling Condition, I don't know they look excellent (from pics), probably fired at the range. Winchester 94AE rifles are high. For the longest time they were going for $300 to $400. Then when Winchester stopped making them the price just about doubled over night. But I don't know if they stayed high like that.
Be carefull they could be stolen and have not been reported yet 6 months from now the guy comes back from over seas and finds his guns are gone then reports now you have stolen guns you could ask for a copy of the person driver license and have them make out a bill of sale on the copy with a notary they don't play with stolen property any more and the bill of sale not going to always help you out.
No matter what you do, if they are Stolen, and you are in possession, once reported To local LAW Enforcement, they will be taken from you, and into Evidence, PERIOD... You lose ALL your investment, unless you recover from the Jerk that sold them to you... Whenever I am about to purchase a USED FireArm, my first call is to my State Trooper Detachment Commander, and have him do a Search of that Weapon By Serial Number, of All relevant DataBases, preferably BEFORE I take actual possession, and Log them in to my Bound Book. If they come back clean, Great, or if they are Stolen, I do not conclude the transaction, and inform the LEO, of That case, and who does have possession of the weapon. Nothing can allow you to keep a stolen weapon, Period... Documentation can show Good Faith, on your part, that can mitigate a charge of Posession of Stolen Property... Which in some places, when it comes to FireArms, is A Felony, and. Would cause a loss of your 2nd Amendment Rights.....
I understand the not keeping the stolen property thing, they were from BIL who was "forced" to take them in trade for paying a mortgage payment for this couple, I would prefer if they were stolen that he deals with it, not me. Which is why I asked if there was somewhere else other than the local LEO, or LGS that had the data base. I think it is a legit, and I am not paying for anything that I am not keeping. Also understand, that "Down the Road" should these weapons be found to be Stolen, in the future, You are liable for " Trafficing in Stolen FireArms" should their a Providence be traced back to you... So again Documentation is critical, to mitigate such a Charge against you, personally...
The only thing special about the 94AE is they are pretty good and winchester stopped making them. Probably due to perceived market saturation. When they stopped making them it just made people want them that much more.
I have a Paratrooper buddy who’s in the Police. He runs the guns I get for me Nothing hot yet. I haven’t had to deal with that.
I dont know if its different with states but, here an indivisual can not just call the sheriffs department and request a check on a serial number. My wife has worked BATF extensively and with laws based around firearms for 15 years. She also audits other gunstores that have BATF paperwork problems. She says that pawnshops can not even request a serial number trace unless there is suspition that it was used in a crime and is directly linked to a perp. She also says that pawn shops have to turn over all used firearm paperwork to the NICS center every 3 months to be reviewed for crime info. Heres the real kicker. Even if you bought the firearm from a pawnshop that isnt a guarantee that its been checked. Bottom line, unless the weapon was bought new there is no way of telling if it was used in a crime as far as I know. The police have to deal with BATF the same way everyone else does. There are procedures and everytime a check is done all the correct paperwork has to be filed. Traffic violations are a legit reason to do a serial check but, they are not supposed to otherwise.
Here in GA, person to person transfers are legal and are not very heavily burdened with regulation. But, you should always exchange copies of drivers licences when doing so with people you are unfamiliar with. If they are unwilling then, it should be a deal breaker.
Look on Gun Broker at some of the prices that are being paid. That will give you some idea of what they worth. There is also a Marlin forum you can check into. If the Marlins are (JM) made ,the price will be higher. The (JM) will be stamped on the barrel. The Winchester will go for around $700.00 to$800.00 or more. The scopes on the Marlins will raise the price a little bit.
Here in Alaska, I have a very good relationship with My local Detachment Commander of the State Troopers...(the same guy who gets a copy of my FFL renewal Forms) If I need a Serial Number check on a weapon, I can just call him up, and get an answer in 24 hours... I do this every time I take in a Weapon from ANY Source, other than a NEW Weapon direct from an OEM or Distributer... You just NEVER Know the Provenance of a Weapon, no matter what the Guy selling it says... I bought a Browning Auto5 from a guy once, for $200US, and when I did a Serial Number Check, it was reported Stolen, in 1946, but the owner had long since Died, the Family couldn't be located, so the Record was Cleared, out of the Database, and I transfer it to my Son, when he got Married... If it could have been returned I would have done so, and the Guy would have gone to see the Judge, and explained how he came into possession of a Stolen Weapon.... Similar thing happened to a High Standard .22LR SemiAuto Pistol I took in on Trade... again it was a very OLD Report and the Owner couldn't be located... So it sat out on the Front Porch, to shot varmints with, and then when I was on vacation, one spring it disappeared... I am pretty sure I know who absconded with it, but had No real proof, so ATF was Notified, and a New Stolen Report was filed in the ATF Database, and it hasn't showed up in 25 years. The suspected Perp, is still alive. I see his crap on Facebook, so maybe when he croaks, his family will try to sell or pawn it, and I will get it back... Stranger things have happened...
