Romney signs off on permanent assault weapons ban

    - July 08, 2004

Governor Mitt Romney has signed into law a permanent assault weapons ban that he says will make it harder for criminals to get their hands on these guns.

“Deadly assault weapons have no place in Massachusetts,” Romney said, at a bill signing ceremony on July 1 with legislators, sportsmen’s groups and gun safety advocates. “These guns are not made for recreation or self-defense. They are instruments of destruction with the sole purpose of hunting down and killing people.”

Like the federal assault weapons ban, the state ban, put in place in 1998, was scheduled to expire in September. The new law ensures these deadly weapons, including AK-47s, UZIs and Mac-10 rifles, are permanently prohibited in Massachusetts no matter what happens on the federal level.

“We are pleased to mark an important victory in the fight against crime,” said Lieutenant Governor Kerry Healey. “The most important job of state government is ensuring public safety. Governor Romney and I are determined to do whatever it takes to stop the flood of dangerous weapons into our cities and towns and to make Massachusetts safer for law-abiding citizens.”

The new law also makes a number of improvements to the current gun licensing system, including:

    Extending the term of a firearm identification card and a license to carry firearms from four years to six years;

Granting a 90-day grace period for holders of firearm identification cards and licenses to carry who have applied for renewal; and

Creating a seven-member Firearm License Review Board to review firearm license applications that have been denied.

“This is truly a great day for Massachusetts’ sportsmen and women,” said Senator Stephen M. Brewer. “These reforms correct some serious mistakes that were made during the gun debate in 1998, when many of our state’s gun owners were stripped of their long-standing rights to own firearms. I applaud Senate President Travaglini for allowing the Senate to undertake this necessary legislation.”

“I want to congratulate everyone that has worked so hard on this issue,” said Representative George Peterson. “Because of their dedication, we are here today to sign into law this consensus piece of legislation. This change will go a long way toward fixing the flaws created by the 1998 law. Another key piece to this legislation addresses those citizens who have applied for renewals. If the government does not process their renewal in a timely fashion, those citizens won't be put at risk because of the 90 day grace period that is being adopted today.”

“Never before has there been such bi-partisan cooperation in the passage of gun safety legislation of this magnitude in this nation,” said John Rosenthal, co-founder and chair of Stop Handgun Violence. “I applaud the leadership of the Governor, Senate President, House Speaker and entire Legislature for passage of this assault weapons ban renewal. They have shown that Massachusetts can continue to lead the nation in protecting the public and law enforcement from military style assault weapons.”

The main reason we don't just up and shoot folks we disagree with is that we are a nation of laws, and such activities are not looked on with benevolence or kindness. Even advocating such has pretty severe consequences. (The trick, of course, is getting the laws written such that the Constitution is not violated in the process.) Welcome aboard, Hunter, but please go thru our Code of Conduct (rules) one more time.

Am I reading this wrong, or did this happen in 2004? How can you enact a permanent ban? Can't the current leadership write new legislation to overturn it?

Of course they can. "Permanent" in this case means it doesn't sunset, meaning no further action has to be taken to extend it. The previous AWB required action to prevent it from falling off the books. We are delighted it did, at least I am. So far as I'm concerned the sunsetted bill fairly well proved that the law had no effect on crime reduction, therefore, says me, we don't need another, sunset or not. If they do enact a "permanent" ban, then it can be overturned. (Fixes are harder to do than doing it right the first time, not so?) These damn laws get turned off and on rather willy nilly, so it seems to me, the only thing they are having a hard time with is the Constitution itself, and that is getting rubbed raw along the way. well Ghrit you know that the Constitution is just an outdated piece of paper. Why it was made when everything was different so we really don't need it anymore anyway right.? Oh and whilst your at it just turn in your guns so you don't hurt anyone because that just wouldn't be nice.
I'm so glad that I don't live in Mass. What a crock of crap.
    Take care Be safe Poacher.

Yes, Sir, the Constitution was written a long time ago, and things were different. But saying that principles are outdated runs counter to my way of thinking. At the sure and certain risk of stating the obvious, there isn't much difference between stealing a horse or a car, or someday in the future a private flying device, there is still theft.[soap]

    Good morning, choir --

from what I have read, Gulliani is no different and McCain is just a vote chaser with few differences from Hillary. I can't take much more of these politicians and their BS. They make me sick how they can change the views over night that they used to get elected. It wasn't what they believed, but it was what the people wanted to hear.......really, their just doing it for the sheeple.

Our forefathers were totally right.....no democracy has survived the long haul and that is why they chose the best of democracy and the best of a republic and bound it with a written Law of the land.

Our gradualistic slide as our Constitution "lives and breaths" has lead us to a far more democratic society than was envisioned and as a result, the central government has become more power and as it does so it will suck up every resource, right, privilege, dollar, and in the end the "majority" will be the demise of the country. Pretty soon, the majority will be all the non-taxpayers and when that happens our great democratic republic will be quickly replaced with a social democracy.

As long as we have the rights to guns, our government will ultimately be in check but once that is eliminated, there will be no concern because our ability to "check" the government will be gone and they will have nothing to fear.
