US Virgin Islands Siezing Guns and Ammo Ahead of Hurricane Irma

    It appears that the US Constitution does not apply to the US Virgin Islands. Under the guise that the National Guard somehow lacks firearms and ammunition (the responsibility of the Governor to ensure, I might add), the US Virgin Islands may now confiscate the firearms and ammunition owned by private citizens. This sets a nasty precedent that can be used elsewhere. :

    "U.S. Virgin Islands Gov. Kenneth Mapp signed an emergency order allowing the seizure of private guns, ammunition, explosives and property the National Guard may need to respond to Hurricane Irma.

    Mapp signed the order Monday in preparation for Hurricane Irma. The order allows the Adjutant General of the Virgin Islands to seize private property they believe necessary to protect the islands, subject to approval by the territory’s Justice Department.

    Mapp issued an emergency declaration Tuesday and mobilized National Guard units to prepare for the massive storm.

    “This is not an opportunity to go outside and try to have fun with a hurricane,” Mapp said. “It’s not time to get on a surfboard.”

    Irma strengthened to a Category 5 storm Tuesday, with wind gusts hitting 175 miles an hour. Irma’s eye is expected to pass just north of the heart of the U.S. Virgin Islands on Wednesday and bring four to eight inches or rain and 60-mile-per-hour wind gusts. ... read more at the link below"​

    The VIs are a possession of the US not a state. While the residents enjoy many of the rights of US citizens, the Constitution does NOT apply there. In fact, the islands do NOT have a constitution at all tho' they are self governing. Also, the residents cannot vote in US senate, house, or presidential elections. They do send representative to both houses, but I am not sure what their voting privileges are.

    Well, that's special. Can't say that the Island National Guard isn't well armed or supplied, but thank God they have uniforms, boots, transportation, housing and food for them. The U.S.V.I. are a territory of the United States and has no Constitution. They are governed under the "Revised Organic Act of the Virgin Islands" approved by Congress in 1954. There are apparently no protections afforded its citizens like those in our Bill of Rights.

    The US Virgin Islands are a "Protectorit" not a Territory, so it is NOT US Soil, and US Statutes do NOT apply...

    Visited there in my Navy days, pretty place.
    But this indicates they have a leftist government.
    Definitely off my list for any future visitation.

    The canoe club put me ashore on liberty once on St Croix and once on St Thomas. Nice places to visit. But yup, rights are not the same there as here. They have their own local laws, however federal laws apply without all the protections of the BOR.

    Probably not. There is a link to the order, although the link is on the daily caller itself. The Oath Keepers are reporting it now too, although again, the daily caller seems to be the source of record.

    They too are calling this an unconstitutional act, which it isn't. They are cutting law that doesn't apply, and protectorate or not, possession or not, it's NOT the good 'ol US of A. It's almost, but not quite, like saying you should have your BoR protection when you travel to a foreign country, which is hogwash. You'd like them, sure, but again, it's not "America".

    While it's frustrating for US citizens to be affected like this, it's not illegal, its not unconstitutional, and it's not on American soil. The article is a tempest in a tea kettle and designed to get people riled up about a non issue.

    The NEWS Rag "The Daily Caller" is saying the NRA is readying a US Federal Court Challenge, to the Weapons and Ammunition Confiscation Order, issued by the Governor of the US Virgin Islands... They cite a 2006 Federal Statute signed into LAW in 2006, by George W. Bush that forbids such a move, by ANYONE in the Government.... So let the DC Circuit Court sort out what IS and what ISN"T LAW, in the US. Virgin Islands....

    Lovely place, worked there a few time, played there a couple times. Had a watering hole called the Sunset in St. Thomas. Hope they are OK.

    Ah, LEAPING LARRY (aka DINK) earned his nickname on St Croix, prior to getting hitched to my cousin. Needless to say, the rules of engagement directed by the Establishment in the Virgin Islands had little significance to Americas front line Frogmen. But I'll bet the VI Residents with a couple of Republic Credits in their pockets are still well armed?

    Spent some time in the USVI and vicinity when I was young and considered moving down there a few years back. A quick look at the lack of constitutional protections combined with the Fed running everything convinced me S. Oregon was still a better option.

    I would bet there are numerous Monkeys whose personal collections would add up to more firepower than the VI National Guard would be able to collect from their population as a whole.

    We could get up the "Monkey Marines Militia" with some charter boats, run down there with our milsurp rifles and poodle shooters, take over the USVI and make it a Free Land.

    I think this action by the VI tells us what government would do if it could. It also shows us the relevance of the BoR and the 2A going on 230 years. The 2A is the difference between a citizen and a subject. I'd rather my government turned to me, a Citizen, and ask for my help rather than take what I have that they fear to leave in my hands. If you were a VI subject having your government disarm you at the time of possibly your greatest need is a very bitter thing.

    Notice that you do not hear stories about gun confiscations coming out of Houston. The Governor of each state is the CO of the National Guard in that state. Obviously in Texas the Governor stands up for his citizen's rights. We will soon likely see if Governor Scott of Florida is a true Republican or not.

    Being a retired Florida state employee, I have no liking for the unprosecuted criminal Scott. Very few do. But, he has always been accounted a Second Amendment supporter. He won't confiscate our guns.
    Many of those confiscations in Nawlins were by out of state LEO brought in who were unfamiliar with the laws of a free state. If the state's NG troops do it, they to are breaking state law.
