    What do you do with a guy who has practised law for only 3 years, has never tried a case, and is unanimously rated "not qualified" by the American Bar Association's judicial rating committee? Why, nominate him, and confirm his appointment as a lifetime US Federal Court Judge of course. TRump isn't draining the swamp....he's just stocking it with his critters, regardless of their fitness for the job.

    I will look into why they are deemed unqualified by the ABA. We've recently had two sitting senators insinuate that judicial nominees were unqualified because they are theists. That reasoning would have negated the authors of the Declaration of Independence and the Constitution.

    I'm far more concerned about a sitting Supreme Court Judge who doesn't think the US Constitution is the best choice, or another Supreme Court Judge appointed because she was female and Hispanic and not because of her record.

    As to the judge in the link: "The ABA did not disclose their committee’s reasoning for declaring Talley Not Qualified, but the decision was unanimous.". WTF does that mean except "we don't like him and won't say why"? Why don't they WANT to say why? Is it for the same reason the other nominee cited in the article as disqualified because he was conservative? Only leftist activist judiciary allowed and not those out of date folks that follow the outdated Constitution written by all those racist white men?

    I would be interested in seeing a citation to the nominees who were criticised by the "two sitting senators" for being 'theists". It would have been unusual for there to have been non theists among the founding fathers.....that a significant number of deists among the founding fathers is as close to having godless (from a Christian perspective) members of the first and subsequent Constitutional Conventions.

    According to news sources that ABA has not published in the media an account of the criterion upon which none of the panellists could support Talley's nomination to the Federal bench: but the vote was reported ad unanimous. Apparently Trump's nominees were approved, on party lines. I guess TRump is desperately stacking the Federal benches in anticipation of a possible hostile Senate consequent to the looming 2018 mid term elections. Fitness to hold office, is secondary to an partisan ideological commitment to rulings in a more conservative direction. Even if TRump gets kicked out on his Rump in 2020, his judicial appointees until that possibility eventuates are more likely to be beneficial to his business interests than more neutral, non partisan candidates.

    The present SCOTUS comprises a whole bunch of theists.....mostly Christian (Catholic and Protestant) together with a sprinkling of judges from the Jewish faith....individual religiosity, is not necessarily decisive in the formulation of many of the judgements and rulings that they have made. What matters is looking at legal issues and conundrums impartially on their legal merits, rather than on the basis of commitment to particular theological doctrine.....

    In a country comprised mostly of theists, why is it so strange/horrific that many of our judges as theists as well? Why is it wrong for judges to be theists?

    Also a very key point here in the difference between a citizen and a subject - our freedoms and rights come from a higher authority than man. Were those rights and freedoms granted by Man rather than by God they would be subject to being revoked at any time rendering us subjects at will. As they are granted by God those inalienable rights continue to be ...inalienable.

    OK, there are only 9 supreme court justices, so the terms you're using (ie: "a sprinkling" or "a whole bunch") are all pretty vague or diachronic. While here in the US we have a bill of rights that prohibits religious discrimination, it should be noted that around 82 percent of the US self describe as theists. Thus, the idea that the SCOTUS comprises a whole bunch of theists is actually representative of the US (as well as the world, as greater than 80 percent of the world self describes as theistic). If someone is out of step in this scenario, it isn't the theists...

    Perhaps Mr Talley's spectacular lack of actual court work https://www.linkedin.com/in/brett-talley-61990b23, and his extensive 3 year post bar exam legal experience, may have had something to do with it.....perhaps if this dude, upload_2017-11-13_16-42-45. spent more time in court , actually trying cases instead of blogging and writing ghost stories.....Brett J. Talley, the ABA might have been more impressed by his candidacy.

    Perhaps Talley's fantasy fiction writing skills as speech writer for US Senator Rob Portman Rob Portman - Wikipedia and Mitt Romney Mitt Romney presidential campaign, 2012 - Wikipedia caught the TRumpinator's attention?

    Gorsuch got a unanimous WQ (Well qualified) rating from the ABA, and several other Trump nominees were given well qualified, or qualified assessments without dissent. The ABA isn't exactly a hot bed of socialist activism.

    I commend to you and others here to read through the ABA's background brief on the process of evaluating and recommendations concerning Presidential, Federal Court nominees. The process isn't merely some kangaroo court created by vested interests within a trade union of 'liberal' legal beagles.....the process has an interesting history, beginning with a GOP President, (Eisenhower).     To add to this excellent statement, the ABA is itself something of a discredited joke that no one besides left wing partisans take seriously. Like the American Medical Association, they used to be a respected, unbiased professional organization. Now they are just another liberal suck up and have the record to prove it.

    Being trashed by the ABA is hardly an insult if you are conservative.

    Anyone who thinks ABA approval is a universally accepted objective standard is either a leftist hack or has no genuine understanding of the American judicial system.

    I dare say it's actually worse because it leads to pre-judging and rumor. Agree that disclosure is good, but that USA Today article says exactly nothing about a real, existing conflict, but only that there are possible future, un-named maybe potentials. The ALA may be right about his qualifications, but the article is nothing more than a smear. That sort of media is yellow.
