Hawaii asking prescription Marijuana users to surrender guns

    Hawaii has been known for strict gun laws and monitoring gun ownership. Medical marijuana is now available to Hawaiians but you cannot own guns if you hold a medical mj card.

    The Honolulu Police Department is ordering legal cannabis patients to “voluntarily surrender” any guns they own because pot is still considered an illegal drug under federal law.


    The initiative continues three months after Hawaii’s first medical marijuana dispensary opened for business.


    “Your medical marijuana use disqualifies you from ownership of firearms and ammunition,” Honolulu police Chief Susan Ballard wrote in a Nov. 13 letter to one medical marijuana card holder. “If you currently own or have any firearms, you have 30 days upon receipt of this letter to voluntarily surrender your firearms, permit and ammunition to the Honolulu Police Department or otherwise transfer ownership.”

    Exactly right... The Federal Statute is very CLEAR on this point, and it is up to the States to enforce it if they choose to, and Hawaii CHOOSES TO... So if you are a DOPER, then you are A PROHIBITED PERSON, Federally and in Hawaii... and if they forward your name to the FEDs, you get on the NICS List as A PROHIBITED PERSON...

    Maybe the government should get the violent criminals, felons and other prohibited persons to surrender their guns first.
    Have some priorities that make sense maybe, for once. No?

    @oil pan 4 - While I agree with the sentiment, it's easier to track down someone who has effectively voluntarily submitted to being on a list as a prohibited person (Medial MJ) than it is to track down some if not most otherwise prohibited individuals. Criminals and Felons typically don't buy their guns via an FFL so there is no ability to cross-reference the two "lists" if desired.

    It's a bit of a straw man argument, although like I said, I agree that they are putting too much effort (read: any) into one side of the issue and not enough into the other. Then again, I'm pretty much anti any anti-2nd statutes anyway so...

  5. Anyone who thinks you shouldn't own a firearm if you smoke cannabis has definitely never smoked before. There's absolutely nothing dangerous about it (if you're an adult) except for getting caught with it on you.

    Exactly but I am really beginning to believe that this is a generational thing. And in about 20 years we will see the attitude that was programed in is gone.

    But I did not post this to debate marijuana. I posted this to show that one state is collecting guns or giving the prescription holder the option to sign transfer ownership. Personally I believe it is wrong but it is the choice of the state. I think transfer of ownership was a good move thus husband can transfer to wife, parent to child (adult) etc...

    An un-needed distinction, period. A user, by any other name or source, is a user. The point of the OP was that users are prohibited persons, and the legal users are now on a list in HI, and the state is hoping listed users will volunteer for confiscation of their property. Illegal users (meaning those not abiding by FEDERAL law) are not so listed.

    That will be fun to watch in the Federal court system.

    Vehicles kill way more people than guns.
    If they can't own a gun why allow them to drive a car if it's so incapacitating?
    That begs the question, why is any firearms prohibited person allowed to drive?
    Maybe part of the reason so many people die in car crashes.

    There is way worse stuff you can be on then medical grass.

    No, it is okay if this thread wanders, that is how most conversations are so all thoughts welcome. Argue away @oil pan 4. And that is a good question but the feds believe that mj is an illegal drug. Some states follow fed laws and other states choose not to follow the swamp. Colorado has decided not to follow the feds.

    How about the Feds and the State just butt out period. Something I read somewhere about "shall not be infringed."

    They last time some of the states told the federal government to piss off, that started a series of events which lead to the north attacking the south.
    Lots of slippery slopes.

    I guess the people of Hawaii need to make a choice of what is more important. If one has cancer and is prescribed mj for nausea and to help with appetite, they will have to give up their 2A in order to receive medical care that could help. Doesn't seem right but like I said earlier, at least they can transfer ownership but in HI owning a gun requires a few steps.

    Actually, Since this is a State issue, it will be fought out in the Hawaii State Court System... They are just following the Federal Statute, and Residents of that State will have to make a choice... and it is NOT just the Ownership Issue, it is also a Possession Issue.. So if you are determined to be a Prohibited Person, then even possession of a FireArm is a Violation of the GCA of 1968 as ammended... a Felony.. for which if convicted will confirm them as a Prohibited Person...

    Everything is illegal in the US
    If it's illegal in your state just move to the next state where its legal.
    Or, Just grow your own and keep your mouth shut.

    I have Good friends in WA state that smoke dope & we shoot together !
    At the Gun club they flipped out after I had been there 10 years cleaning & doing the "Grandpa (buddys same age)" stuff with there kids & grand kids . They all know me & didn't know I was a Brit /Canuk . One day they heard my Brit accent as I was just back from Jersey CI.
    Some asked & went overboard etc. Crazy , Did .MIL time in a Canuk /Brit ..

    So last I was down , I heard that they had places to buy dope ..The buddy's look after the house that one of the there kids use / rent from me since im mostly in CDN & JCI . I stopped in , showed my ID ,Canadian Passport & i was in , Cash only & so for 20 bucks I got two thank you's for my buddy's. No receipts as I can remember & the turn over if in & out was more than Walmart .
    They had 20 guys/folks behind the counter & many customer knew what they wanted .

    I had good help (I don't smoke squat) . I was asked questions I had no idea how to answer . All I said ,was make it a good scotch .
    They sold me 2 sealed "Buds" and the Guys said that it was great .
    We Don't drink or smoke before shooting & when doing maintenance / repairs etc. Tools go down & now we can have a drink / toot ...

    Gun club has gotten over the overreaction and we still do Kids night for all (Grandpa's ) pick up the price of the rounds 22lr for all the clubs rifles . This way we keep the kids & parents busy & seeing how they can shoot. Gun club has it's completion for all ages .
    Great Fun & seeing Kids grow up.

    "Asking...", "option..." - Nope, it reads as a demand to me. An unConstitutional demand. I'd be moving back to the mainland, WITH my guns.
