If you fire anything that could be considered an anti personal round out of a 37mm flare gun it needs to be registered as a DD, because unlike a smooth bore cannon this weapon fires fixed ammunition.
Flares, smoke, bird disbursement firecrackers no.
Shooting things like bean bag, rubber buck shot, wood dowels, any hard ammo, make it a DD.

Makes it about as useful as a Nerf gun.

To me it's more cost effective to buy a bare LMT receiver as a non-NFA item and register it on a form 1 as a 40mm and 37mm.

I like to fire anti-personnel rounds, great big lead ones that I make myself. I like the bore to be way larger than half an inch in diameter too. Sometimes I even load buckshot and larger lead balls at the same time. Last time somebody tried to stop us from doing this it didn't end well for them.

It doesn't fire fixed ammunition. Not a large bore DD.

Good catch OP4. That ruling apparently came out in 2015. Without being able to fire even a chalk marking round it pretty much makes it pointless to have a grenade launcher tube at all.

I have never owned one, but I do have a pile of very nice 37mm plaster projectiles. The guy who made them was excited about it until the first misfire. His hopes fizzled, just like the black powder he'd used as a propellant. If he'd baked ALL the moisture out of the plaster it would likely have worked. As it was the longest range he got from any of them was about 15 feet, and much of that was from rolling down the hill. I snatched them from the trash, and have had them in the warehouse for years.

I have nothing that size to shoot them from, and now that nobody else can use them without government permission I'll use them as targets. White dust to go with the charcoal briquettes that I hang from strings for the kids to shoot. :)

So... if a guy loaded a primed 37mm case, then poured black powder in from the muzzle and topped it with a patched round ball, it wouldn't be a DD? Hmmm? Golf balls are 42.7mm, but a D battery is 33.2mm. (Pill bottle plaster or concrete projectiles would be better for the environment.) Heavy felt patch would work fine. ;-)

And therein lies the beauty of the black powder cannon and mortar. Like the musket, they aren't large bore Destructive Devices. They can resemble modern 60 and 81mm mortars so long as they have no firing pin and the ammo is lit with a fuse (like a fireworks mortar) or other lanyard (friction, flintlock, percussion) firing device.

I'm really not trying to hijack your thread. Your original post asked for our opinion on NFA (Title II firearms.)

First and foremost, I don't like the idea of asking permission to do anything. I couldn't afford to feed a MG if I wanted to, and I don't, so that's out of the question. I've been shooting rifles almost as long as I am tall for most of my adult life, and found the M16 plenty handy indoors, in vehicles and aboard aircraft. I've always wanted to shorten a shotgun barrel to 18", but can't bring myself to cut off a perfectly good choke. So that leaves suppressors and DD's, (and AOW. Again, no interest.) Where I work and shoot, unless everybody else had one, a suppressor wouldn't do me any good. It is possible to load large centerfire ammunition that is silent without a silencer. I've done it, by accident. (Search Cat-sneeze loads. I'm not a fan, having seen the damage Secondary Explosive Effect can have on a firearm shooting a steady diet of extremely light loads.)

So that leaves DD's. I grew up around Civil War mortars and cannon. Living on the beach I would love to have a Lyle Gun (line launching cannon). When I have the time there are lots of black powder mortar and cannon projects I'd like to build. The beauty of it is that there's no need to ask permission.

My last form fours have been out for almost 5 months.
    It will be very soon.

Funny thing a guy at the gun store said he didn't want to end up on all kinds of lists by buying an nfa weapon.
Well when you get caught with an unregistered one you will end up on all kinds of lists.
    Court docket.
    Bond list.
    The felon list.
    Prison role call list.
Some ones list of regular bitches.
    Parole.
Booty call lists from guys you were in the pen with when they get out.
The list of usual suspects for you local police to immediately suspect anytime anything happens, they find a hookers stuffed in a dumpster, obviously it was that guy who had a weapons charge 3 years ago. This was just his gateway hooker.

The only things I think should be on there are explosive DD and machine guns. Since criminals really made a mess of things with free access to machine guns in the 1920 and 30s.
Plus who wants all of Obama and Clintons unvetted Syrian refugees and south american ms-13 gang members to have free access to RPG7s, blasting caps and machine guns?

Yeah but now when they get caught with a machine gun they're probably going to do at leat 5 years if it's their first offense.
As If it would be their first offense or the only offense they get charged with, haha.

I was asked why do you need that?
    "That" being NFA weapons.
I tell them you really don't want to know all the answers to that question.

I stopped by the friendly neighborhood NFA arms dealer. The form 4 that are coming back here lately are from 10 months ago.

6 months ago the turn around was about 6 months. Now here I am 6 months later the forms are taking 10 months.

Now the gun store I got them through is "closed and reopening soon" for no apparent reason.
It's not like they are doing a remodeling project or anything.
