Rumor is she is retiring next year? I hoped she would end her reign in 2020 so the left could let all the crazy out and make the Kavanagh circus look like a pensioners only dry bridge club. I say nominate hillery. She was a lawyer or something once right?
Not sure where you heard that rumor. RBG herself has said that she plans to retire at 90. That is 5 years away. Besides do you really think RBG wants DJT to pick her successor? She would rather die on the bench then let that happen.
I agree with MM34 on RBG wanting to make a statement on her term in SCOTUS. RGB wants to remain "on the job" until she keels over terminally. This will be her way of solidifying an almost martyr status among the dem left, as well as those who believe in the SCOTUS as a policy making tool, rather than as a check on the Constitutionality of law, as originally intended.
While I'd love to see Trump pick her successor (likely Amy Coney Barrett AKA ACB) I am hoping for a speedy recovery. Rib fractures are very painful - perhaps she will reconsider her remaining years and quality of life. IMO she is already at the point where the duties are beyond her physical abilities evidenced by her frequent unplanned naps.
Next time we get somebody who won't be so damned timid pushing her! Hard to get good help these days.
I see these life long tenure Judges as an real problem. Roosevelt, who is definitely not one of my favorites, tried to sweeten the deal to get them to retire at a reasonable age but once they get power most want to stay until the bitter end...much like our politicians. Personally, I think they should be retired at 65...they have become too powerful and actually make de facto laws via their rulings rather than simply interpreting the law.
The problem is precedent. Many decisions by the court are based on another court or case decided by the SCOTUS in the past. If those cases border on Constitutionality and a recent decision then more liberally uses that decision in a later case, it moves that later decision further from the Constitutionality test that the Supremes are supposed to be employing. I wish RBG a quick recovery and hope she does not have complications as a result of her injuries. Growing old is not a fun thing and she has struggled with health issues in much of her life.
IMHO, She should be replaced. I learned as a schoolboy the answer to the question, "How can you listen to a presentation if you sleep through it?" The Answer: (Surprise, surprise) You Can't!
Well, I will not be as polite and nice as the majority here but, spending a life overseas removed most of my 'angels of better nature' and sweet sensitivity out of me, so I do not wish her well. In fact, I hope the pain is so horrid that she realizes it is time for her to step aside. The hell with her...and with all the power grabbing politicos.
Her supporters will start making 3d printed replacement parts and organs for her. She's gonna be there until after the 2020 election. And if Trump wins .. she'll be there until after the 2024 election. Assuming there is a 2024 election.
