New Bill Bans Building AR-15s and Buying, Selling Parts for Firearms
Written by Joe Wolverton, II, J.D.

Representative Frank Pallone, Jr. (D-N.J.) has submitted a bill that, if passed into law, would be one of the most expansive restrictions on firearms and firearm accessories ever enacted in the United States.

Pallone’s legislation, H.R. 7115, mandates the prohibition of all the following:

prohibit the sale, acquisition, distribution in commerce, or import into the United States of certain firearm receiver castings or blanks, assault weapon parts kits, and machinegun [sic] parts kits and the marketing or advertising of such castings or blanks and kits on any medium of electronic communications, to require homemade firearms to have serial numbers, and for other purposes.

Beyond the obvious congressional overreach and oath-breaking that is central to every provision in this gun grab, the title itself is purposefully misleading, amounting to nothing more than “click bait.”

Titled the “3D Firearms Prohibition Act,” 3D printed firearms or firearm accessories are only the tip of this totalitarian iceberg.

Consider, for example, that if you build guns for a hobby and this bill passes, you’d better look for another hobby.

I know many of you are saying, “There’s no way a bill like this passes.” Yes, you’d think that, wouldn’t you?

Reading the bill closely, it is obvious that the bill has nearly nothing to do with 3D printing of guns, but anyone aware of the fact that congressmen rarely read the bills they vote on also realizes that this broad ban could actually make it through the House and the Senate relying on nothing more than its name.

Does anyone reading this article doubt that there are scores of lawmakers in D.C. who would vote for a “ban on 3D printing of guns” even if the bill has very little to do with that subject? How many bills claiming to be one thing are actually nothing more than tyrannical Trojan Horses, hiding betrayal of the Constitution?

Here’s Ammoland’s summary of just how huge an impact on the right to keep and bear arms Representative Pallone’s bill would make:

The bill will ban the selling and all forms of advertising of parts kits for modern sporting rifles. Upper and Lower parts kit allow a user to build their own guns using a stripped lower or upper receiver.

In a vast majority of these situations, the user buys a serialized lower receiver from a gun dealer. These serialized lower receivers are considered firearms and fall under all state and federal firearms laws. They require a background check like any other firearm.

By preventing the sale of parts kits, the bill would make it almost impossible to repair a rifle. When something breaks, the gun would be useless. The bill doesn't seem to exempt licensed gunsmiths from the law. It would make all semi-automatic rifles impossible to repair even by a licensed gunsmith.

The writers of the bill also did not specify their definition of a parts kit. A drop-in trigger could run afoul of this new law if the federal government decides to define such a device as a “parts kit.” It leaves the door wide open for more gun bans by redefining “parts kit.”

Now, there are many ways for Americans to actively oppose this attempt to leave them less prepared to prevent being left disarmed and disadvantaged against criminals and congressman.

First, and perhaps the most obvious and least effective, is for Americans to contact their federal representatives and senators, reminding them of the sacred oath they took upon taking office. Any congressman or senator who would vote in favor of reducing the scope of the Second Amendment is an oath breaker, and a tyrant. Period.

Now, if Americans are serious about walling themselves off from any and all attempts by agents of the federal government — including regulations issued by any of the scores of executive branch bureaucrats — they must rebuild and buttress the barricades of federalism, namely state governments.

Every state in this union retains this right of refusal owing to their role as creators of the federal government because they, the states, created the federal government and reserve the right to resist the exercise by Congress of any powers not specifically granted to it by the states in the Constitution.

States are, it is true, bound by the terms of their agreement (the Constitution) that created the federal government, but they have no obligation to sustain acts of the central government that go beyond the boundaries of that agreement.

This principle is easy to understand by answering the following question: Would anyone enter into an agreement with others to create an entity that would have unlimited authority over them?

A better question is: Could they create a government with greater power than they themselves possessed?

State governments could not create a central authority with any degree of power unless they held that power in at least an equal degree prior to the latter’s creation. Put another way, could the states give the central government something they themselves did not already possess? The very thought is ludicrous!

To better appreciate this concept, take it down to the personal level. It is logical and apparent to anyone that I can’t give one of my neighbors permission to rummage through the garage of another neighbor because I don’t have that power myself. I can’t give my neighbor permission to paint another neighbor’s house because I don’t have that right, either. I could, on the other hand, give my neighbor permission to paint my own house because I have that authority. Why do we fail to breakdown these questions of sovereignty and power into more manageable questions that every man, woman, and child could understand and give correct and rational answers?

Fortunately, when it comes to the right to keep and bear arms, not only did the states give no power to the federal government to interfere in it, but they explicitly prohibited it from infringing whatsoever on this critical liberty.

The Second Amendment states, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

James Madison, in Federalist, No. 46, reminds states that their best defense against federal despotism would be the “refusal to cooperate with officers of the Union” when those officers are attempting to enforce unconstitutional acts.

Finally, you may wonder why I didn’t defend the right to use a 3D printer to manufacture weapons in an article about a bill called “3D Firearms Prohibition Act.”

Well, there’s a simple answer: Representative Pallone’s bill has nothing to do with 3D printing and everything to do with the despotic disarmament of the American people.

This is just the Demoncrats pushing their agenda “ Real Hard” but the actual chance that this get thru the Senate is ZIP... AND el Presidente would NEVER Sign it into law, and there is No Way it could get enough votes in both houses to get aVeto overturn... Even then, it would be challenged in Federal Court even before the Ink was dry, and it is UnConstitutional on so many levels as to be a Steaming Pile of Horse Dung...

This bill goes beyond merely chipping away, more akin to shaped charges.

gotta love that open ended "and for other purposes" clause. No way would that ever be corrupted.

It's all a war of wordsa and the Democraps are winning the sheeple, neighbor is in early 70's, heats mostly with wood, retired truck mechanic with at least 4 firearms that I know of, real nice lever action 30-30 that he deer hunts with, and he recently made the comment that no one needs an assault rifle or over 6 round magazine to hunt with and the government will take care of those domestic terrorists. He would see the 3 D printing and be all in favor of the law as it protects him from the dangerous people, his views are not all that uncommon and his voice is not exactly unheard as his wife is on the school board, and they are active in the local political scene. The new middle class does not in the normal sense work for a living, they no longer are the farmers, skilled craftsman, local business people, etc, now they are the school teachers, white collar employees of the banking, legal, corporate world, the new information and computer systems, governmental employees, etc. They make their living with ideas and paper work, not with skills and manual labor. They believe the lefts line and want to protect their way of life and help the poor etc, as long as it is with someone else's money and in someone else's neighborhood. In this area it is about assault weapons, protecting the environment, the need for free education, free medical care, money and housing for the poor, etc, and the need for someone else to protect them and fund it. Do not make the mistake that most of the people in the USA any longer share our values about our common heritage, the Constitution, or a common set of values based on the Bible and our European past, to all to many, no matter of what tribe or race, it is now looked at as "white privilege" and is to be ignored and if possible outlawed. Using all the modern tools of controlling the media and public information, we see the propaganda on TV of a helpless woman fleeing teargas, clutching her children, and it being classified as a chemical attack on women and children. It looked to me to be a smoke device rather than tear gas, she had came many hundreds of miles, crossed a concreted over river bed and was trying to invade our country by either crossing a border fence or storming thru a checkpoint, and thus in breaking all our laws, we had the legal right to shoot her if necessary, but instead, the government is the bad guy. Tens of thousands are dying of the opioid epidemic, the illegal use of an illegal drug, but in my area they are looked at as victims and no real attack made on those supplying the drugs, but if one crazy person sits in his house with a loaded pellet rifle and refused to come out and surrender to the SWAT team, it will be a breaking news story and they will interrupt their regular programming to show you the latest live chopper footage. If the sheeple and the "minorities" continue to elect democrats and our nation lurches ever farther to the left, in time they will get control for at least one moment and they will then make the necessary changes in our system to maintain that control. A perfect example of this is the laws passed in the 1930's and since on machine guns and other illegal weapons, changing a few trigger parts or using a hacksaw to shorten a barrel will make you a resident in a federal hotel, yet there have been no real crimes commited with those weapons in the last 30 years and there is no chance of repealing those laws..

I think we all need to resign ourselves (me especially) that nothing will truly ever change in this country. Firearms laws will become more and more strict, and, sooner or later, firearms will be outlawed. Yes, yes, yes, I know, the 2nd Amendment. Amendments can be changed or voted out. And, it will be, sooner or later...

We can't do a damn thing about all the corruption, extortion or fiscal mismanagement no matter how hard we try and the only way to truly change this country will be by revolution...and what are the odds of that? It has gone too far and they have complete control of the law and the propaganda machines. We are led to believe that our vote matters only to pacify us. It is hopeless and it's simply too late.

Sorry, @Bandit99 but that is how we got into this mess with our not being a government of and by the people to a people being governed. I can remember my father saying, "You can't fight City Hall." And it is that attitude among those who cherish freedom, coupled with the never ending desire of those who want to oppress thought, impose their will and beliefs upon others that will bring about the changes you have stated. If we silently stand by and let it happen, then we get what we deserve...servitude.

Oh, I hear you! And, I agree with you. But, it makes not one microgram of difference. We can do about as much to stop it as we can do to stop the rain. They are in complete control. 'We the people' died a long time ago and we're not coming back. That dream is dead. Gone. We do exactly as we are told or our lives are destroyed. But, we are fed a lovely patriotic porridge to keep us believing, paying our taxes and sending our young to die. When was the last necessary war? It certainly wasn't WW2 and if you think that I am more than prepared to debate you. We whine and we cry and we bitch and we moan but, in brass tacks truth, we can't do a damn thing because they hold all the cards. The time is coming soon, due to economics, when they won't be able to keep up this charade but it won't really matter because it is already too late. Anyway, this is my opinion, I believe the only way to effect any real change is through complete revolution and the odds of that happening are a million to one, actually way more.

It's all because that there have been so many mass shootings with guns that have been assembled at home, those 80% lowers are particularly to blame since they are untraceable and so easy to make... </sarcasm>

In jolly old England, it is already illegal to have a knife with a point that can be used for stabbing. I can be stopped and held for the crime of possessing burglar tools at any time as my truck tool box and get home bag contain tools that could be used to break into a dwelling. While perfectly legal, my limited gun collection could also be presented to the general public as an arsenal and their attitude is that no sane person fires more than 5 shots a year sighting in their deer rifle, would render the amount of ammo I take to the range and shoot as enough to arm the entire town. Not going to win that or asking the police for a reason to stop you or for a search warrant to check out your house or car. In the eyes of your neighbors, doing so indicates that you have something to hide and you must be guilty of something.

There is no guilt in exercising a right.

If you let them search you then anything they find can be used against you.
But say they want to search you, you tell them to get bent, which does little good because they already are, so they get a warrant for illegal guns, drugs, related activities or articles and evidence.
It's as wide open a warrant as the law will alow short of saying "anything we can find to use against you".
But say all they find the ice burg that sank the Titanic.
You just dodged 1,500 murder charges and some other stuff.
As long as you didn't have any drugs.
They didn't have any probable cause to suspect that you sank the Titanic and didn't put it on the warrant they can't touch you.
And they can't do anything to you aside from investing how you sank the Titanic. They know you did it but they can't use the iceberg as evidence. All the witnesses are dead and the evidence is a mile underwater so you're probably home free.
Of course it's not your iceberg and you didn't know it sank the titanic wink wink but you can't tell them that if you invite them in and they find it.

In thinking about Judges, and Search Warrants.... Has anyone ever heard of a person who has had a Search Warrant granted, on bogus Information, ever sued the Judge for granting the Warrant? I mean we hear about cases where the LEOs get a Search Warrant for a Specific Address, on a CI’s information, and blow the door off it’s hinges on entry, Scare the residents silly and scare the children to trama, or have an accidental Discharge while conducting the Search, or any other BAD OUTCOME, and then find out it. was ALL BS, and the LEOs are very sorry, but “ These thongs happen.” So isn’t it up to the Judge to determine if the information in the Warrant Afidavit is valid, BEFORE they sign off on it... There should be a Statute that makes False swearing in a Afidavit a Felony Crime, and that when such is found the individual be prosecuted for it, no matter WHO they maybe...

Only if they bust into your house and shoot you and it can be proven that the warrant is a complete work of fiction.
Then the police department takes the hit.
Aside from the large transfer of currency, whoever the snitch they used or say they used takes the bulk of the fall.

I believe they usually settle out of court if they bust in you house, looking for someone you have nothing to do with, go to the wrong house or use bad or made up intel.
And part of the agreement is you don't talk about it.
