    Bill Would Boost Penalties for Criminals Using 'Assault Weapons'

    (CNSNews.com) - Hoping to reverse an "alarming trend," two Florida state lawmakers, both Democrats, have introduced a bill that would require stiffer mandatory sentences for criminals who use semiautomatic or automatic weapons.

    The legislation also targets criminals who fraudulently acquire assault weapons and sellers who "know or should have known the buyer was using false identification."

    In a Feb. 6 news release announcing the bill, State Senator Gwen Margolis and Representative Evan Jenne mentioned a case in September, where a 25-year-old fugitive shot and killed a Miami-Dade police officer with a semi-automatic rifle.

    In 2006, there were 19 reported homicides involving assault weapons in Miami-Dade County alone, the lawmakers said.

    The bills introduced in both the Florida House and Senate (SB 782/HB 425) would require a mandatory life sentence for a criminal who uses a semi-automatic or automatic weapon during the commission of a crime, resulting in death or serious bodily injury.

    Criminals using those weapons to commit crimes that do not involve death or injury would get a minimum 25 years in prison.

    And criminals who use false identification or identity theft to buy or sell a semi-automatic or automatic weapon -- even if they do not use it to commit a crime -- will face up to 15 years in prison and up to $25,000 in fines.

    "Current law is not effectively assisting law enforcement in getting illegally obtains guns off the street. Our intent is to provide law enforcement with the tools necessary to keep the public safe," said Jenne.

    The lawmakers said they hope to "break the supply chain and reduce the number of illegally obtained guns in our communities."

    The legislation has the support of the Miami-Dade Police Department, the Florida Police Chiefs Association, the Florida Sheriff's Association, the Fraternal Order of Police, and the Police Benevolent Association, the lawmakers said.

    However, Second Amendment groups are expected to reject the legislation. The South Florida Sun-Sentinel quoted one lobbyist for the National Rifle Association, who called the proposal flawed.

    Thats funny I thought a gun had to be capable of full auto fire to be an assaut weapon .

    O wait thats just how the true small arm experts cassify them and we all know a Democrat with a law degree or anyone who listens to a Dem with a law degree makes them more than an expert on any subject .

    I personally think this stiff penalty should apply to ALL criminals using ANY weapon - even bare-handed. No 'time off for good behavior' either. Crack down on the badguys! Drafting legislation particular to a specific weapon is bad - let's ban the CRIMINALS!!
    If Homey knows he'll go away for half a lifetime for doing the crime, he might think twice.

    There are plenty of laws already in place to prosecute people that don't want to obey the law. Perhaps ridding the system of it's revolving door would be a better solution and actually punish people for crimes commited.

    Don't forget the gang bangers get more respect and power from their gang if they go to prison. It is like having a Bachelor's degree on your resume to them.

    Homey don't care if he goes away for a few years - helps him 'make his bones'. BUT - going away for twentyfive or more years . . . even the most hardcore Gangsta doesn't want to be out of pocket THAT long! His position in the gang gets usurped - he's just an 'old man' when/if he gets out. But, mothing is certain - if he's so stupid he still doesn't care, neither do I - lock him deep and toss the key away.

    They've "the criminals" already figured out the "System" is full to the gills and they'll get kicked loose because the politicians wont spend the money to build new prisons because then they couldn't steal as much money as they have been for decades .

    At the Rate we're going in a few decades only murderers will even see the inside of a cell .

    Rapists , child molesters and all the other scum will get an ankle bracelet and be turned loose long before the next century arrives .

    I remember what a major impact on major crime the death penalty had and stiffer sentences, and three-strikes....wonder why the crime rate still climbed with all those measures to make us safer?

    Mostly because none of them are used enouph. They wont KEEP the banger that shot a 5 yo girl in prison for 25-life, they reserve that for folks who dont pay their taxes. They wont keep the rapist in prison for 20+ years, thats reserved for the guy who didnt buy a tax stamp for his gun that he never used to shoot anything other than paper. They wont execute the guy who murders a dozen people in cold blood, thats reserved for the one who dose it in an election year or who dose it to an out of hand criminal poseing as a LEO.

    Our criminals are no 'toupher' than those in 'uncivilized' countries where repeat crimes are nearly nonexistant, its just that those countries beat the hell out of you in the town square with a stick and let your homeys watch you scream like a girl and beg them to stop when its a 'lessor' offense and if its serious you ADD a long stay in a prison that we all know is a nightmare (thus the image attached to things like 'a Mexican prison' or 'a Turkish' prison) and NOONE wants to go back, commit a serious crime like rape or murder and you are either publicly executed and your homeys watch you soil yourself as your neck snaps or at the least you never come out of the prison.

    Actualy USE the penalties we have in place or make them more meaningful AND get rid of all the BS 'crimes' (if its victimless it is NOT a crime) so you have plenty of room and yeah I figure they would think, but only once before 95% of them figured out they didnt want to pull the crap. I have heard cons state when they got paroled or realeased that they were simply out on vacation, the prisons as they are dont bother them, especialy when its only a couple years at a time then a few months of vacation. Make it permenant and make it less pleasant and that will change.
