AKguy facetimes the ATF director and says "so someone in the 35 free states can just go cut the barrel down on their shotgun without any legal ramifications?" The AFT director: "Yeah"
I don't get the interest in whatever gun a person uses, just what they do with it. Murdering people is illegal,unless your an Israeli in Gaza. Or a mother killing your three children. I saw an ad on YouTube about buying one solvent trap and getting one free. It was odd seeing this.
Best bet with solvent traps is treat them as firearms, since the 1968 gca defined them as such. If you live in a free state, buy the trap, have them ship to your local gun shop that does silencers and transfer it as a firearm on a 4473. That way it kicks all the liability back to the solvent trap seller. Or just buld your own from hardware store items.
The official letter on the NFA explains that the act was enforced based on the US governments power to tax. When they removed the tax on an item, they could no longer require its existence to be controlled and it became a state matter. Thus you still had to follow the rules for manufacture, sale , etc, if there were an existing tax. Thus $200 tax on machine guns gave them the right to control those weapons. https://www.atf.gov/media/30961/download I may be wrong, but I think it means that the rights we were given back were based on a narrow interpretation and that if a Democratic controlled government were to tax those weapons, the old rules would apply. In a narrow sense it is a loss to a lot of gun owners as it both makes the existing state laws now the rule and removes the federal oversight. It also limits your rights in taking objects from one stat to another as the federal rules are in play. It also does not do away with need to file a form or to have a firearms card of some legal type to buy firearms. The legality of that is based on the 1968 GCA act which requires the checking on the status of the individual buying the firearm in order to prohibit sales to individuals that are by law prohibited from buying firearms, The ultimate impact of the rule depends on both the state you live in and the beliefs of those who control our legislative systems. It is not based on some major Supreme Court reading of the Constitution at this time. Other decisions by the court have modified the right of individuals on the purchase and control of firearms.
So here is my question that I have not found an answer for: Can I now make an SBR, SBS, and Suppressor at home with no paperwork?
Depends on where you live. I can't in North Carolina, because the State law requires that these items still must be registered.
Yeah, PA doesn't allow silencers and short barrel shotguns (legally termed "sawed off shotgun") without a form 4, but allow short barrel rifles. I'm waiting to see how the legislature handles this.
I imagine that if it's legal in your State and there's no longer any Federal requirement...it's just like manufacturing anything else of your own. The tough part is if the laws ever do change in the future you would be liable to obey any pertinent rules. But up here in the land of idiots who only care about hunting, the State morons still believe we ought to obey the (outdated) Federal guidelines, until it is changed. This will take time.
Michigan as I understand it still requires a form 4 to be legal though I’m told there is a move to end that. I’m not holding my breath.
there's reports - that there are new vendor sources cropping up all over for the oil filter adapters - they see the door open to an open market for them ;;;;;;
Something in the back of my mind keeps screaming that it's a trap. As I read it, the law isn't gone, the ATF has just said they wouldn't enforce it. Please correct me if I'm wrong. I asked a cop 2 days ago if SBRs were legal to have now, and he said "yeah, absolutley". However, SC Code of Laws Title 23 Section 23-31-320 and 23-31-330 still require registration of them. So for me right now in South Carolina I'm gonna hold off on an SBR until the waters clear up a bit on this issue. Probably will get the suppressor I have wanted though.
Yeah theres like 15 states that have nfa bans or mirror laws, 8 of those states decided they wanted to be extra gay and ban silencers altogether. So you still have to put your SBR, SBS or silencer on a form 1 or 4 in those mirror law states. No such gay communism is new Mexico. If you want to take your nfa items interstate it seems they need to be registered, to keep the gay communists out of your ass. I've got plenty of registered stuff I can move around if I wanted to.
