(WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station. When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong. Cruz is now charged with battery on a police officer, as well as DUI and obstruction.
Joke or not, funny. I can't help wondering if the judge will take it seriously and let the charge stand.
How can you basically illeagalize a normal body function, the judge may let the charge stand, but will definitly be overturned by the appellate courts at a large cost to the state.

This reminds me of an old friend that passed away a couple of years ago. Larry was a recovering alcoholic, of about 20 years sobriety. He used to love telling stories about what a messed up drunk he was. He told me that one night he had gotten really drunk, got behind the wheel of a car, and got pulled over. After he failed the sobriety test, the officer put him in the backset of his patrol car. Drunk Larry then proceeded to crap in his pants. Once the stench hit the front seat, the officer pulled over, opened the back door, pulled Larry out, closed the door, then took off and left him on the side of the road. Crapping in his pants got him out of a DWI. God I miss Larry.
Does that make my pot of beans a Destructive Device? If the judge can stop laughing, He may have to make motion to air the facts and open the windows. The poor guy was scared s****less. Sounds like a lot of hot air to me.

The Kanawha County prosecutor's office requested that the charge be dropped against 34-year-old Jose Cruz. Cruz, of Clarksburg, W. Va., was pulled over early Tuesday for driving without headlights, police said. According to the criminal complaint, Cruz smelled of alcohol, had slurred speech and failed three field sobriety tests before he was handcuffed and taken to a police station. Parsons after being taken for a breathalyzer test. "The gas was very odorous and created contact of an insulting or provoking nature with Patrolman Parsons," the complaint alleged. Cruz acknowledged passing gas, but said he didn't move his chair toward the officer nor aim gas at the patrolman. He said he had an upset stomach at the time, but police denied his request to go to the bathroom when he first arrived at the station. "I couldn't hold it no more," he said. He also denied being drunk and uncooperative as the police complaint alleged. He added he was upset at being prepared for a breathalyzer test while having an asthma attack. The police statement said he later resisted being secured for a trip to a hospital that he requested for asthma treatment. Cruz said the officers thought the gas incident was funny when it happened and laughed about it with him. Cruz, who was arrested Tuesday, still faces two charges: driving under the influence and driving without headlights, and two counts of obstruction.
