Supreme Court packing

    It's no surprise that sleepy Joe wants to add more judges to the Supreme court. JMHO here but I think it's because that voter fraud cases will make it there and will be provable. Dear leader is trying to cover his a$$ by doing so. What do you think?

    I wish it were that simple. There are several different views of what the Constitution is and should be. One view, and the major reason for the first 10 amendments, was that it was a fixed document that secured certain rights that were necessary for a diverse people to live in harmony over an extended period of time. These rights included the right to express your opinion, defend yourself against the central state and to have a fair and open legal system with equal rights for everyone, etc. Any rights not given in the Constitution to the central government, belonged to the states. The rights were not granted by the 10 amendments, they were protected and insured by the 10 amendments.

    A second and more open view of the Constitution is that it is a living document and since it was written over 200 years ago by a bunch of white upper class people, it may not fit our present needs. A study of how the articles has been handled by the legal profession over the last 200 plus years will show how it in fact if not in theory been modified. While it would take years to fully understand the document below, a quick look at any of the explanations on any of the amendments will indicate how the courts have modified the documents and limited them over time.

    If you do start reading this document, be aware that is a very deep rabbit hole and that almost any subject you click on is presented in such great detail that if you have a mind like mine, you may not escape for hours. It is in fact a very good introduction to federal law and since it is based on actual cases decided by courts, it has a lot of the nature of the old Perry Mason series and while it may seem dry, it in fact documents how we live and I might add, are ruled.

    If you take the view that it can and should be viewed as a living document, then the democrats idea that it is necessary to change the very structure of the court makes complete sense. That you may be throwing the baby out with the bath water is unimportant. We tend to forget that the very nature of the argument nearly prevented the forming of the United States and in one sense lead to the war between the states.

    Looks like the bills being sponsored today in both houses are to increase SCOTUS by 4.

    It's close as the Dems control the HoR by 2 and the Senate is evenly split with VP Harris the tie breaker. To prevent it will require either flipping three Blue HoR's or one blue Senator. There is hope, but not much.

    There is so much talk about SC Justices being conservative vs liberal. This is wrong. Politics should mean nothing to a USSC or any other Justice. It's also an attempt by politicians and the press to make you think the USSC is another "R" vs "D" situation.

    What is commonly being termed "conservative" means that the justice interprets the Constitution as written and takes the opinions of those passing that portion into consideration. Their personal views mean squat. Whether needs changing or not is up to Congress and until that happens what is currently there is the law.

    "liberal" in this context, means that the Constitution should be interpreted the way they would like it to be as opposed to how it actually is. If that justice feels like First Amendment rights should not treat all religions the same or even if the First doesn't apply to religion since they are personally Atheists and all that superstition is silly then that's how they rule. That's why they are commonly referred to as "activist judges; They want to change the law without the legislature's involvement.

    It's incredibly dangerous to allow the Judicial or Executive branches to circumvent the Legislative branch.

    The legislature is hot on packing the USSC so they don't have to be held accountable for passing laws that remove your rights and turn them into privileges. That's what this dance is really all about.

    This is insane. And, I truly hope people see it as such. Julius Caesar started this and look what happened to him! FDR also tried this crap but it did not go through. There is absolutely no logically reason for it...except for the Biden administration to push through radical Bills that he knows will be shot down by the courts. Scary stuff...and tied with the coming inflation due to uncontrolled spending it will finally kill America within the next 2 years, we'll never make it to midterm elections, as if a vote even matters anymore.

    We have a very clear method of making changes to our Constitution and B.o.R, and this latest move to pack the court is simply to allow the Political power in majority to side step that specific process! They know that they would never have the votes needed to effect any amendment(s) to the B.o.R, so this is the only method available for them to decide things for us WITH the courts blessings. It's dangerous enough to view the Constitution in any way out side it's very strict writings, to do so is to strip it of it's authority's and power. To view it with any political slant is to remove the voice of any who appose those views, and thus, prevent a large number of folks from being represented by those documents. To view it as a living document is to attempt to side step the process of changing parts of it to fit the days ( political powers) needs, if needed, and that's why there is such a specific requirement for effecting any changes!
    For any politician to take the stance that it can/should be changed, but who chooses to side step the method of change, shows exactly what kind of power they think they have over the people!
    This is a day if reckoning, we ether adhere to those sacred words, or we will have no choice but to revolt and have war! This cannot be allowed to go forward, and as it is, those pushing for this need to be tried for high treason and hung by the neck till dead, while the rest are made to stand at attention, and watch the last twitch's, while the flies come home to roost in their bodies!

    The reason for appointing SC justices for life was they would not be influenced by the changing of the other branches of government (elections) and would rule only on what was constitutional and not on their own political beliefs. Unfortunately it has not worked that way in a long time it is now a power play between liberal /conservative SC justices. For years the liberals have had a majority on the SC and that was fine and dandy with them, now that the court has moved to the right the DemoRATS want to pack the court in their favor and this can not be allowed to happen. If this occurs the Republic is dead and the Constitution will be meaningless and the road to socialism will not be a road but a highway to hell.

    The problem here is that while many members of this forum do use logic and defend different views, often totally at odds to each other, we do it with some thinking. However last night on my way home from work, I stopped at a coffee shop to pick up a blueberry muffin for my wife and a cup of coffee. Came to four dollars and change, gave bill to the person running the cash register, a high school graduate that we know, to pay for purchase. She was then informed that they were out of muffins and I needed to be refunded price of muffin and tax. She could not handle the problem, supervisor called, she had to reset computer and re enter purchase and was basically unable to figure out what my change was. Given the lack of a real education, the lack of critical thinking by most people, the level of propaganda on the mass media and the complete collapse of any fiscal responsibility by the state and federal governments and the new concept that everyone has a right to unlimited care, even non citizens, I am afraid that we are in for a rough few years. It may straighten out or it may leads to a total chaos. The jury is still out.

    Always remember that FDR tried to pack the SUPREME COURT back in his day, because it was striking down much of his Socialist Plans to end the depression... Congress wouldn’t go along with that, so it didn’t happen, but it was a contentious debate for a number of years...

    While this may not be the place to post this data, nor may it be part of the subject, the attacks on the Constitution and the use of our laws to target black males, the fact remains that while the 16 to 44 year old black males make up about 3 % of the population, they commit about 50 % of all murders. Below are the official governmental statics, though I suspect that sort of chart will soon vanish as it does not neatly fit the belief that all of the racial problems are due to white power and control of the system. Note that rape and sexual assault are no longer covered. The first chart is for 2019 and the second for 2015, the data would seem to indicate that Trump did not in fact create all the problems between the racial groups. If you scroll down in the 2015 data, it breaks it down to the below 18 age group and the data is even worse.

    Blacks have major problems in their community/culture which they refuse to speak about in public. It is much easier and profitable to blame the system (whitey) for all their problems-- victimhood has become an industry in this country fostered by the liberal media.

    Nope, there are really good reasons that our founders made Supreme Court Justices and ALL Federal Court Jurists, lifetime Positions... As spelled out in the Constitutional Debates on the issue during the drafting of the Constitution... First and foremost, it takes most of the Politics out of the Federal Judiciary... Once appointed by the President, and confirmed by the Senate, they can only be removed by DEATH, Stepping Down, or Impeachment FOR CAUSE... This makes them sum-what immune to State and Local Politics... Yes, that also is a Double Edged Sword... but has a Proven Track Record for over 200 Years...

    This idiotic push to "pack" the court has only one goal, to let bidumb (or his handlers) load things up while he's in office. If the legislation allows a graduated increase with subsequent prexies appoint one new justice per "tour of duty" other than normal replacements my objection level will drop just one point.. I have some doubts that will ever be suggested. "For life" suits me well, it does tend to reduce peloosley and shoemer type interferences. (Most especially if term limits for congress critters is enacted.)

    That said, I see no gain to an increase above the current 9.

    What I would rather see is the Supers actually holding power over the states, as in; once they hand down a ruling, states cannot deny it and must adhere to it! Kind of like D.C vs Heller, we know several states said it was wrong and simply ignore it and make up shit on their own that clearly goes against it! This is only a small example, Roe vs Wade being another one, with the bible belt denying the courts finding and doing what ever the hell they want! When the states can simply say they disagree with the high court, and there is no redress to that then where is the actual power of the court, where is it's authority, and more importantly, why are the states not held their feet to the fire!!!

    Don't even think about over turning roe vs wade. If neocons rally to turn roe vs wade the other guys are going to rally and take something from us.
    There's nothing I'm willing to risk to stop the loonies from killing their unborn. Hell it's probably the only thing keeping their numbers some what in check.

    If the demoRats are successful in packing the courts especially if Odumbo gets on there you can bet our Bill of Rights will be attacked with a vengeance. All who are currently serving in the military and all who have served took an oath to protect and defend the Constitution if you get my drift
