The "Don't Tread on Me" Flag just got trod upon – by the Equal Employment Opportunity Commission.

The EEOC is investigating whether the Revolutionary War-era Gadsden Flag could be considered a racist symbol in the workplace. In recent years, the yellow flag with its coiled snake has also become a symbol of the Tea Party.

“Whatever historic origins and meaning of the symbol, it also has since been sometimes interpreted to convey racially-tinged messages in some contexts,” the EEOC report states.

The distinguished writer Eugene Volokh first exposed this absurd story in the pages of the Washington Post. Here’s the back story:

In 2014, a black government worker filed a complaint alleging he had been discriminated against by a coworker who wore a ball cap that bore an insignia of the Gadsden Flag.

The aggrieved government snowflake “found the cap to be racially offensive to African Americans because the flag was designed by Christopher Gadsden.”

The EEOC report goes on to identify Gadsden as a “slave trader & owner of slaves.”

The overly-sensitive employee “maintains that the Gadsden Flag is a ‘historical indicator of white resentment against blacks stemming largely from the Tea Party.”

The EEOC conducted a “thorough review” and found there was no evidence that the flag was created in a non-racial context.

“Moreover, it is clear that the flag and its slogan have been used to express various non-racial sentiments, such as when it is used in the modern Tea Party political movement, gun rights activism, patriotic displays, and by the military,” the EEOC report states.

You can almost feel the “but” coming, can’t you, good readers?

“However, whatever the historic origins and meanings of the symbol, it also has since been sometimes interpreted to convey racially-tinged messages in some contexts,” they declared.

Citing the “ambiguity in the current meaning” of the Gadsden Flag, the EEOC has decided to investigate to “determine the specific context.”

The government’s ruling is going to open up a great big can of worms, folks. They are basically suggesting that if an item is used in a racially-tinged context or if a worker thinks something may be racist – it is therefore racist.

What happens if a white guy shows up to work with fried chicken and collard greens in his lunch pail? Could he be accused of cultural appropriation – even if he simply enjoys finger-licking good cuisine?

As Mr. Volokh pointed out – there was no evidence the gentleman who wore the Gadsden Flag cap said or did anything racist to his coworker.

The worker’s sole objection “was apparently just to the wearing of the flag, and the ideology that he thinks has become associated with the flag,” Mr. Volokh surmised.

Well, using the government’s logic, they could very well ban white bed sheets and reruns of the “Dukes of Hazzard.”

One can not help, what another perceives of a Symbol... To base a Discrimination Complaint, on such a subjective issue, is beyond me... I would be in Federal Court, appealing any such decision...

Frankly, I don't give a spit what the Equal Employment Opportunity Commission thinks or says. Lots of people were slave owners back then. Next they will be banning Jefferson. I do thank them for helping me make up my mind whether I should put up a flag pole or not. And, the Gadsden Flag will be flying right under the stars and stripes. These people need to get a REAL job because they definite got too much time on their hands if they come up with crap like this.

I have to say that this piqued my sense of humor a little. A "government worker"...working for a government designed and established by a group made up of mostly slave owners. And yet a hat makes it a hostile workplace.

Actually in the 1860 census, only 8% of the population were slaveholders. Of these aprox 500,000 were black freemen who owned slaves.
    .
So, just to correct your statement above about lots of people back then were slave owners. In truth a very small percentage of the population just prior to the Civil War were slave owners!
    .
Feel free to look it up yourself. I know I am correct!

I have to wonder though, what percentage 500,000 black slave owners was of the black population?

    Let's see...

    Total population in 1860 - 31,183,582
slaves as a percent of the Total Population - 13%

    So, 31,183,582 X .13 = 4,053,856 slaves in the U.S. in 1860

Assuming they were all black, 500,000/4,053,856 = .1233 or ~12.33%

    interesting....

Also depends on the definition of "slaves". A good many of the "slave" population were actually sold into indentured servitude. Both European and African. Many slaves were Irish. They preferred slavery in the US to starving in their homeland. The Arcadians in Lousiana, which we know today as "coon asses" were indentured servants. The term coon ass came about when the Arcadians migrated down the east coast from Canada and began arriving on the Gulf Coast. They indentured themselves to land owners and were put in the fields following the black slaves to learn how to pick cotton. Thus the term "a coons ass"

The Gadsden will be allowed in certain branches and worn by seals, They must however pay for their own patch.....

Good point. There is more than just a tad of difference between indentured servitude and slavery. In a way, servitude might be seen as slavery, and indeed some may have treated it so. In the more common situation, a craftsman took an apprentice who indentured himself to learn the trade (or as happened, his family signed him up.) The period of indenture varied greatly, but the idea was that the apprentice would achieve status as a craftsman, and while learning the craft, the craftsman provided room and board in return the labor.

That's true with traditional European indentured servants, wherein the goal was to learn a trade. That was common also in the original colonies. However the southern "slaves" of European descent, mostly Irish, were simple laborers who sold themselves for usually very long times, if not for life. Many were given a type of sharecropper status after years of service. Including many of the black slaves. The number of traditional African slaves was not as numerous as modern history likes to portray. Many were given their freedom to fight for the south in the civil war. The last confederates to surrender was the crew of a submarine which included a free black. The last official confederate unit to surrender was an all black unit that vowed to fight to the death when cornered and surrounded on a mountain top in Georgia. After running out of ammo and food they reconsidered and surrendered.
History is written by the victors not the vanquished.

Our IBEW apprentices are indentured for 5 years before they turn out (JW). Many of them liken their status, to that of being our slaves.....
