Too good to be true? The NFA may be dead for SBR, SBS, AOW, and silencers...

This would be great for all of us.
That means the government is doesn't like it.
Still a fair chance that this is going to be fought against by the feds.
We really can buy/build SBS, SBRs and silencers without complaint from the state.
There are 50 states out there. And those asshats can't enforcing their existing rules that were superseded by federal law. But now w/o federal laws .. shazam, state laws are now enforceable.
Y'all think CA, IL, NY are going to allow it?

Michigan already has a law on the books:

FIREARMS: SILENCERS OR MUFFLERS: MICHIGAN PENAL CODE: Possession of firearm silencers or mufflers The possession, manufacture, or sale of a firearm silencer is permitted in Michigan under MCL 750.224(1)(b) if the person is licensed or approved to possess, manufacture, or sell such a device by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives, as required by MCL 750.224(3)(c). Possession, manufacture, or sale of a firearm silencer by an unlicensed or unapproved person is a felony, punishable by up to five years imprisonment under MCL 750.224(2).

Notice the part that says .. you can own if if you are licensed OR approved. Well, as soon as there is no longer an approval process or a license required by the feds. Do you think that the state is going to say, well, we've got this law on the books and it's been there for a long time, Yeah, we are gonna prosecute you for possession without fed license nor fed approval.

I predict there are other states that have this verbiage on their books as well.

    And the saga will continue.

I am not a lawyer, but this is my opinion.

Well, Silencershop sent me the email and since they are the main plaintiff in the case, it makes sense they will be forthcoming.
The NFA Registration Is Gone: What Silencer Shop Foundation v. ATF Win Means for You
Essentially we still have about a week until it becomes final. If it isn't appealed, we're all set. Buying a suppressor will be easy. But -we aren't quite there yet. Read the information at the link provided for all the details.

I predict that there is going to be a brace to a stock in the future ... only if it holds (And the state modifies their lawbook)
So, not anytime soon if we get a democratic gov and legislature.

I've been around long enough to see a smoke and mirrors possibility.
Considering it's nearly the weekend. We bomb the shit outta Iran and the wider conflict kicks off. The ATF/DOJ files an appeal or requests an exception and that'll fly under the radar as der be chootin in the middle east. Can kicked again.

So I'm not holding my breath until it's law and the state doesn't fuck around.

I'm torn on this one. We only have an NFA because of the Bonus Army march on the Capital to get the US Government to pay the bonus due to cash strapped WW1 Vets during the Depression demanding their money. It had nothing to do with crime and everything to do with the fear of Congress over the Second Amendment being used as intended.

There are a few advantage to a firearm that has NFA status that can be very useful in addition the usual inheritance benefits.

NFA items are handled much differently by law enforcement than non NFA items. For example, any that are taken by local or state police that were not used by the owner in the commission of a crime MUST be returned or it becomes literally a Federal issue.

NFA trusts can be positive as they will also allow for sharing among trustees without paperwork and fees. For example, in my State if I want to loan a hunting rifle to a buddy the rifle must be transferred via 4473 and fees each direction. Note that you can now SBR any rifle for free and at the same time transfer it to a trust.

The disadvantage is registration, but we already have de-facto registration even in states like mine that ban such. Our State Police have been caught twice now without even a slap on the wrist.

The whole premise a gun being perfectly legal, then if the barrel were to become slightly, sometimes insignificantly shorter now that gun is so dangerous that just having it warrants 10 years in prison, a $100,000 fine plus revocation of rights, if they don't just show up and kill you. Is simply insane.

Anybody can still start a trust. There is no advantage to the current situation with government control. It's like comparing having tyranny or not having it.

    It's August 12, 2026!!! We'll know by 5:00 pm EST...

I've been hearing so many rumors about what's going on behind the scenes; like a split down the middle of the DOJ, where half want to appeal and the other half telling them NO, they are not.

Imagine if you will, going to your local gun shop and filling out a 4473 for a 9mm silencer and walking out of the store with it, to go shooting with it ten minutes later.

Or buying an SBR or SBS with just a 4473 like any other firearm, or no paperwork at all if it is a private purchase.

This is my pivot point; my litmus test. If the administration allows (somewhat) a restoration of our sacred gun rights, I'll believe that they are looking out for the betterment of the country by returning to the US Constitution. If they appeal and turn the decision over, well then, they are rat commie bastards.

    WHICH WAY WESTERN ADMINISTRATION?

My understanding on this, and I could be wrong, is that you must be a member of one of the plaintiffs (NRA/GOA/etc.). This does not impact the nation as a whole, at least not until the Supreme Court tackles it, if they do.
Still, I'm waiting to get a suppressor or 2.

Silencers should not even need a 4473, I can even see the case for making them mandatory in certain situations such as recreational shooting or hunting near a residential area.

Which funny enough, is exactly how Geat Btitain sees it. They restrict the guns, but the "mufflers" are unrestricted. Even pellet rifles wear them there.

Remember some senator thought people might use silencers to poach game during the great depression or criminals could start using them in crimes. That's why they were put on the nfa which was nothing more than massive power grab.

Still waiting. I do think that there are a few recent decisions that make large portions of the NFA irrelevant. It's been several years now on the pistol brace thing. That's made SBR and SBS registration pretty much unnecessary for most folks. They had an issue with bump stocks, but now a FRT is okay? That one I don't understand.
ATF allowed a special designation for some short barrel pistol grip shotguns like the "Shockwave", calling it a "firearm" on the 4473. Is that as far as the elimination of AOW registration will go, or will they open it up to 40mm grenade launchers and
    Howitzers?

I'm all for removing all the restrictions from 1986, 1968 and 1934. We just have to wait and see how it shakes out.

I don't thing a lot of machine gun owners will let the registry go without a fight, since it has supported the value of their transferrable MG's.

I don't know, the vast majority of transferrable machine guns are antiques, rare, and usually very well maintained. They should retain a large portion of their value based on that alone.

That being said, I do believe that a certain class of lawyers that make a living solely on gun trusts or such... They may be setting their hair on fire right now.

I think that 40mm grenade launchers would be classified as destructive devices rather than an AOW.
As for machine guns, a west virginia law maker introduced a bill to create an Office of Public Defense within the West Virginia State Police to buy and sell military-style machine guns to qualified state residents. Man I hope that works out because i might just move there.
