He is being charged with first degree criminal trespass. Seems like there should be a few more charges tacked on there. Not a legal eagle so don't know yet, though isn't trespass when you go on someone's property, not into it? Seems into it would be break and enter. So two charges right there maybe.
It isn't Burglary, unless the guy had removed property. It is Criminal Trespass, if he is just inside the house.... YMMV....
