It'll be interesting to see how this plays out, but I'm thinking that although the homeowner has a pretty clear cut case of civil rights violations, he isn't going to convince the court that the Third Amendment comes into play here. No matter how "militarized" our police get, the court isn't going to consider them "military." On a side note, I was dismayed at how few "hard news" sources there are for this story. It shows up on countless blogs and forums, but on very very few actual news organization sites. Meanwhile, we can read all we want about Dennis Rodman or any of the Kardashian idiots. A sad state of affairs.
Agree that a 3rd A violation might be hard to get because most sheeple don't realize that LE is so militarized. They are definitely guilty of burglary since they unlawfully entered a dwelling and committed a felony and theft.
Will keep an eye on this one. I won't say it will never happen here, even considering how lazy our sheriff's department seems to be. A bunch did come out to be in the parade our town had Saturday at least. But they didn't throw any candy like the firefighters did...I wanted SOME return on our tax dollars...
Definitely a sad state of affairs when ones celebrity status is more news worthy, than the bending and breaking of our constitution we see everywhere in today's society!!
NOTHING will happen or change, even if the suit is "successful". Those in power like it that way and will, are, and will continue to do anything to keep their positions.
Im not sure this will fly as a third amendment case, but the civil rights violations are off the chart. not to mention that if the homeowners were detained by the police on the property then i'm pretty sure that the police would be guilty of kidnapping too. i'm with VisuTrac on this, its going to be an out of court settlement with gag order.
That would be most likely, but the family is quite angry. They are not REQUIRED to accept that outcome. I will be watching with interest.
B&E, destruction of private property, kidnapping, assault, communicating threats--should be a grand day in court for them.
