A Federal District Court Judge has granted a Preliminary Injunction that stops the State enforcing this Gun Ban Statute, in the State of Illinois… This injunction was issued from the Federal District Court for Southern Illinois…
That's why NM didn't go full retard on guns. They would burn every bit of political capitol they have this session and part of next session to get nothing.
On a follow up to the OP… The ruling was after four cases were combined into a single Federal Court Case, and in doing the combining the cases, the Judge also ruled that SemiAuto Pistol Braces also fall under his Injunction, and ATF can not enforce that Rule Change in Illinois. while his Injunction is in force… Surprise, surprise, SURPRISE…
The lawyers are making tons of $$$ fighting the bans and taxpayers are paying tons of $$$ fighting the GOA & NRA lawsuits, when the AR pistol brace lawsuits hit the $$$ will keep flowing.
I didn't see that about the Pistol Brace ruling! Thanks! I have been putting off buying one until this gets sorted out. I do know there are numerous lawsuits in the mill against the ATF Pistol Brace new ruling, one with 26 states. Thanks again!
@Bandit99 It was in the Judges Order for the Injunction.(29 Pages long). and was part of one of the cases that was consolidated into the case that the Judge heard… It is expected that the State and ATF will ask that the Injunctive Ruling will be Appealed to the Circuit Court of Appeals, but as of the date of the OP, the Injuction is Active…
The transcript of the oral arguments have some interesting comments and questions from the judge. - He clearly knows firearms - He seems to be irritated he still hasn’t gotten his Illinois carry permit though he applied last fall! - He cuts right through some of the BS about “assault weapons” asking pointed questions about flash suppressors, magazine capacity, adjustable stocks and specifically if many of these make the weapon easier to use, more comfortable and facilitates better accuracy, aren’t these actually good things that should be desirable? Good read. https://assets.nationbuilder.com/fi...v_Raoul_MPI_Hearing_Transcript.pdf?1681588201
Meanwhile, SCOTUS has requested the state to show cause, and is likely to step in should the courts NOT follow Heller and Bruen!
I'm sure the more conservative SCOTUS have glanced at the IL Congress trash they passed and pizzed more than ever >>> if you EVER wanted the most slam-in-the-eye insult to the 2A Right - you got it throw a truckload of utter shit on the wall - under the pretext of protecting the public - and call it a law - IL has no power over arms importing - soooooooooo you just throw every weapon made overseas and ban them - they supposedly threw in foreign language marketing from foreign arms manufacturers into the bill - IL Congress only saw this after the vote because the actual bill was dropped on the floor at the very last minute .... the first court injunction was based on the lack of procedure in passing this totally blind unread bill >> talking about Banana Republic democracy
Love this guys channel, he really does a awesome job breaking things down and explaining things so we can understand it as it is! Dude is an amazing resource, I highly recommend following his channel!
Here's another Great video, though this guy is a little too smart for many of us, BUT the dude's a genius and really does a good job of breaking down SCOTUS rulings and all the inner workings we never get to see or hear about!
The above Boob-tube-UTube is a very inteligent reading, clear down to the nitty gritty of the issues in the Modern SemiAuto FireArm / Magazine Capacity Cases that are working their way thru the Federal Court System, as I type this… Please listen to what this Supreme Court Bar Member has to say, and understand the SCOTUS Precedents he sites, as they are Law of the Land, in the USA, PERIOD… No Amount of Lower Court Rulings or understandings, or pontifications, or pronouncements, are going to change these FACTs.
7th Circuit Court of Appeals Orders Expedited Review in IL 'Assault' Weapons & Large Mag Ban Big news for Illinois Assault Weapons & Magazine Ban litigation in the Seventh Federal Circuit Court of Appeals…. As I summarized above, The Grabbers are afraid if the Seventh doesn’t move on these combined cases, that SCOTUS will take unilateral Action, and make a Nation-wide Precedent Setting Ruling…
