The latter part of section 3 defines a “flag” as that which is: of any size evidently purporting to be either of said flag, standard, colors, or ensign of the United States of America or a picture or a representation of either, upon which shall be shown the colors, the stars and the stripes, in any number of either thereof, or of any part or parts of either, by which the average person seeing the same without deliberation may believe the same to represent the flag, colors, standard, or ensign of the United States of America. Section 1 states: The flag of the United States shall be thirteen horizontal stripes, alternate red and white; and the union of the flag shall be forty-eight stars [Note: Section 2 provides for additional stars], white in a blue field. Section 3 states: Any person who, within the District of Columbia, in any manner, for exhibition or display, shall place or cause to be placed any word, figure, mark, picture, design, drawing, or any advertisement of any nature upon any flag, standard, colors, or ensign of the United States of America; or shall expose or cause to be exposed to public view any such flag, standard, colors, or ensign upon which shall have been printed, painted, or otherwise placed, or to which shall be attached, appended, affixed, or annexed any word, figure, mark, picture, design, or drawing, or any advertisement of any nature; or who, within the District of Columbia, shall manufacture, sell, expose for sale, or to public view, or give away or have in possession for sale, or to be given away or for use for any purpose, any article or substance being an article of merchandise, or a receptacle for merchandise or article or thing for carrying or transporting merchandise, upon which shall have been printed, painted, attached, or otherwise placed a representation of any such flag, standard, colors, or ensign, to advertise, call attention to, decorate, mark, or distinguish the article or substance on which so placed shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $100 or by imprisonment for not more than thirty days, or both, in the discretion of the court.
A hard call..... Prima facie, it would seem that the law has been broken...it would be an interesting case to prosecute, and it would be interesting to see how effective a Constitutional freedom of expression defence might play out....seems to be just the kind of defence case that Denny Crane and Alan Shaw (Boston Legal) would take on, pro bono...and win! Denny Crane would hate winning, because his client (to him) would be a panty waist, commie liberal; but he would love winning, based on his love for the Constitution and the freedoms that it protects; and that would overide any partisan prejudice on his part against his client's politics. I guess it comes down to what is more important...the respect, dignity and decorum that a national patriotic symbol ought be accorded, as opposed to maintaining the integrity and the potency of another revered national symbol (well, much more than a national symbol actually), the US Constitution; that document that protects the rights and freedoms enjoyed by a nation of citizens.: The right to express one's beliefs and views...no matter how trivial, banal, idiotic, how ill thought, how obnoxious or how painful to the sensitivities of others. Tough call....but I'd be for the Constitution, before the Flag. Edit: If the person in question was convicted of an offence under the US Code relating to the National Flag, and If it were legal to do so....I would not fine the man, nor jail him....but would follow the principle enunciated in Edward E. Hale's story "The Man Without A Country". Truth is, it is probably more of a 1st amendment thing more than anything else. It doesn't matter how distasteful this is to some of us, freedom of expression should be for one and all. I have seen so called art where US flags in Chicago were smeared with excrement, urinated on, walked on, and the police protected the arab like local quasi raghead's right to publicly protest and display his "art". . Considering all the more grevious crimes ignored by Eric Holder's, Obama administration Justice department, I doubt anything will come of this. . A time of atonement is coming. We shall see how it all plays out.
This as much a desecration of our national flag as is peeing on it or burning it. But it seems such desecration is protected in today's Amerika.
Unless the flag is being sold as a Flag of the United States then no law has been broken. Most of the above cited laws are only specifications for what the Flag of the United States should look like and section 3 has no bearing whatsoever because it applies only within the boundaries of DC. I don't like that damn flag anymore than anyone else, but I'd defend his right to fly it. It's always easier to infringe upon the rights of something or someone that is unpopular. Much the way prohibiting felons from possessing firearms was the first chink in the armor of our beloved 2nd Amendment.
I'd have to protect the Constitution before a symbol, no matter how revered. One might get even by taking a picture of the "perp", smear it with turds or skunk juice, and post it on a lamp pole across the street from his residence. I cannot, for the life of me, see how that would be a crime. Certainly an insult, but not rising to the level of libel, slander, or inciting riots, and surely not an assault. I'd hate to try making the argument that it really insults the flag, either. Tough one in court. Who says it is necessarily our flag? No union shown, just the artist's choice to put a picture in the upper left corner of a striped cloth.
We're waaaay too lax with how we treat our flag. Perhaps it is just me, but, I have a problem with flag bikinis...not bikinis, but the likeness of the flag on bikinis. I like bikinis...actually, I just like women. The flag represents (to me) the sacrifices of all those who came before me to make this country what it is .... was. I can see how a liberal douche-bag would want to do this....but for the Kenyan to not openly condemn it shows his hubris...and lack of understanding of what the flag means. On the other hand, I think he hates that flag and what it stands for and would like to see it replaced with something else. Everyone who supports him at this point are mindless idiots who are assisting in their own repression.

I hate this. I also hope for and work toward impeachment, but it is as you said... nothing more than a "cult of personality".
