Police act swiftly after gun purchases

    This has to be the fastest I've ever heard of guns being returned after being confiscated.

    MEDFORD, Ore. -- A Medford man whose firearms were seized by police when he was taken into protective custody this week is seeking legal advice.

    On Friday, the five firearms were returned to David J. Pyles, this after he sent an e-mail to Medford Police Thursday.

    Pyles bought three of the guns after he was placed on administrative leave last Thursday from his job with the Oregon Department of Transportation. The firearms were taken from him when a SWAT team and negotiators descended on his home early Monday morning and he was taken into custody. Police say they seized the weapons after they received information from Oregon State Police that Pyles could be dangerous to others.

    Once in custody, Pyles was taken to the Rogue Valley Medical Center for a mental health check.

    "This is not uncommon. This is reasonable. This is what police agencies do to diffuse potentially volatile situations," Medford Police Deputy Chief Tim George said.

    "To justify my being taken away in handcuffs, forced off my property, my real property as a Medford resident, as a citizen of Jackson County and a United States citizen, legal and all respect, it is most troubling what happened to me on Monday," Pyles said.

    Pyles has contacted the Oregon Firearms Federation for possible legal assistance.

    Police say Pyles purchased a Heckler & Koch .45-caliber handgun, a Walther .380-caliber handgun and an AK-47 rifle after being placed on leave. Police also confiscated two others guns from his property.

    Well, I guess they didn't have a warrant only probable cause. I'm guessing their probable cause was based on what his employer told them, not good.

    426.228 Custody; authority of peace officers and other persons; transporting to facility; reports; examination of person. (1) A peace officer may take into custody a person who the officer has probable cause to believe is dangerous to self or to any other person and is in need of immediate care, custody or treatment for mental illness. As directed by the community mental health program director, a peace officer shall remove a person taken into custody under this section to the nearest hospital or nonhospital facility approved by the Oregon Health Authority. The officer shall prepare a written report and deliver it to the treating physician.

    I watched a different Medford news channel last night and they showed the police delivering the guns back to his house and basically kissing his ass. Never have heard of the PD delivering your guns back to you. Guess they figured that they really screwed up and hopefully he takes them for all there worth.

    I sent an email yesterday to a guy I know that works for Oregon Firearms Federation and if he writes back and let's me post his reply, I'll put it on here. Also wrote the Oregon ACLU to see what their problem is. I know it's obvious, they are liberal anti gun scum, but I just want to see what they say and then give them hell about it.

    That would be good to see released, along with the shrink report, if it can be released. Certainly the cop's report would be in the public domain.

The caller informs you that he is a police officer. He wants to "get you the help and appropriate resources you need."     But this offer of "help" and "appropriate resources" is an offer you can't refuse. You see, your home is surrounded by SWAT teams from multiple jurisdictions. There are men in helmets with machine guns everywhere. Snipers are aiming at your home. You are told to come outside. You are promised you won't be arrested, handcuffed or removed from your property. You are told your possessions will not be confiscated. The friendly paramilitary troops outside your house just want to chat with you.

    Any rational person would recognize the danger in refusing the orders of dozens of heavily armed cops.

    You leave your home and immediately you are handcuffed at gunpoint and taken to a mental hospital for a "psychological evaluation." The police enter your home without a warrant, without permission, without probable cause and confiscate your firearms.

    You have NOT been "arrested" so you have no right to an attorney. You have no right to remain silent. You are subjected to a "hold." You can be held for up to 180 days. You can be medicated against your will. Your crime? The lawful and state-approved purchase of firearms.

    None of this is fiction or speculation. It happened to an Oregonian on March 8th. This is the new face of "gun control" in the age of Obama. Buy a gun, go to a mental hospital.

    David Pyles of Medford Oregon purchased several firearms between March 5th and 7th. In Oregon, a firearms purchase made through a dealer requires the approval of the Oregon State Police. David received approvals for all purchases, but it was these legal purchases that the police used to justify the raid on David's home and the state-sponsored kidnapping that followed.

    Shortly before David made these purchases, he had been put on "administrative leave" from his job at the Oregon Department of Transportation. He was involved in a dispute with a superior which he was attempting to resolve though normal channels and union procedures when he was told he would have to work from home.

    His gun purchases were long planned and the result of some extra cash he had on hand because of a tax refund. David already owned other firearms. But the State Police, after approving his purchases, contacted local law enforcement in what, at this time, appears to be a blatant violation of the law. And because his employer accused him of being "disgruntled," his perfectly legal gun buys became the excuse for an unlawful and unwarranted attack on his freedom and property.

    A few hours after being dragged to an involuntary "psychological evaluation" David was released following clinical psychiatric evaluation which determined he was sane, of no threat to anyone, and of no threat or harm to himself. But the police kept his guns. At first, he was told he would have to wait 2 to 4 weeks to get his confiscated property back, but widespread attention and outrage by media and bloggers forced the police to return his guns.

    His employer meanwhile posted notices warning other workers to run away if they saw David and call police. They also said David had made no threats to anyone.

    David broke no law. He committed no crime and threatened no one. Yet, with no warrant and no probable cause, David was dragged off into the night by heavily armed troops with no legal authority to do so and he was given none of the protections a common thief would get from the legal system.

    We cannot say how his life will be affected by this incident, especially now that, thanks to the NRA and the Brady Campaign joining forces, "mental health" records are being sent by the states to the Obama administration. We do know that this is a very dangerous situation and one the police have refused to explain or justify.

    The Oregon Firearms Federation has been in contact with David since soon after the incident. He as recently expressed an interest in getting some assistance in his legal battle to hold the various actors in this chilling fiasco accountable.

    This is a case with nationwide implications. All gun owners, in fact all Americans should be horrified and fearful of the"Minority Report (film) - Wikipedia, the free encyclopedia@@AMEPARAM@@/wiki/File:Minority_Report.jpg" class="image"><img alt="" src="http://upload.wikimedia.org/wikipedia/en/6/60/Minority_Report.jpg"@@AMEPARAM@@en/6/60/Minority_Report.jpg implications of taking someone by force in the absence of any crime or even an indication that a crime was planned.

    What the gun grabbers have failed to achieve legislatively, they are trying to do the old-fashioned Soviet way. Just claim you're mentally ill and "not cooperating."

    Unsettling behavior in ODOT guns case detailed

    A pattern of volatile, confrontational behavior, the purchase of five guns over three days, and reports that Oregon Department of Transportation administrators had left their Roseburg homes in fear prompted Oregon State Police to conclude that a suspended ODOT planner could be a danger to himself or others, newly released police reports say.
    Less than half an hour after sending out a teletype on March 7 asking law enforcement officers across Southern Oregon to be on the lookout for David J. Pyles, a 39-year-old planner placed on administrative leave March 4, OSP Sgt. Jeff Proulx sent out a second teletype reporting that police had a reason to take Pyles into protective custody.
    In a report released this week, Proulx lists a dozen items that led him to his decision.
    "After reviewing all this information I obtained, I amended the ATL (attempt to locate bulletin) to indicate probable cause existed to detain Mr. Pyles on a police officer's mental hold," Proulx wrote.

    So now he can go back to work right? They asked for his examination, then took it by force, he was cleared and now can go back to work? Am I missing something?

    Regrettably no, you didn't miss anything from what was published. There has to be a back story somewhere. The idea that one lonely cop could trigger such a travesty does not compute to me. POed ex brother in law or something?

    Unfortunately it seems to make sense to me. Too many "officers" have a huge ego and poor judgment. It is not just law enforcement but all areas of public safety it seems. I see no reason for a confrontation when some of my younger brethren see no other way to resolve an issue.

    I'm with Quig though, he did the required evaluation but yet is still unemployed.
