Another sheriff from GA Cherokee Co. sheriff will not enforce 'unconstitutional'... | www.wsbtv.com CHEROKEE COUNTY, Ga. — Joining a growing number of sheriffs across the country who are against President Barack Obama's stricter gun control measures, Cherokee County Sheriff Roger Garrison says he is a strong supporter of the Second Amendment. Sheriff Garrison declined a request for an interview with Channel 2's Shae Rozzi. Instead, his public information officer emailed Rozzi a copy of Garrison's editorial letter and stated that it speaks for itself. In the letter, Garrison said his job is to enforce state laws and the president has no authority to order the county sheriff to do anything. Garrison writes that he will "not enforce any laws or regulations that negate the constitutional rights of the citizens of Cherokee County." ".. nor will I permit the enforcement of any unconstitutional regulations or orders by federal officers within the borders of Cherokee County, Georgia." Rozzi asked Cherokee County commissioners whether they felt the letter is a good reflection of the community. "I do believe his approach is in step with the majority of folks in Cherokee County," said Post 1 Commissioner Harry Johnston. "This is a very conservative and a relatively pro-gun county." Chairman Buzz Aherns believes that Sheriff Garrison will likely see growing support in the days ahead, not criticism. "I think he's just saying exactly where his heart and his responsibilities are," Aherns told Rozzi. "His oath of office is to enforce local laws, state laws and he just reinforced that." Garrison writes that no one other than the governor in a state of emergency can tell a county sheriff what to do. Gov. Nathan Deal kept his response to the statement neutral. "I know Sheriff Garrison," Deal said. "He's a man of great integrity, but I don't try to speak for any other level of government other than myself." In Cherokee County, Rozzi found residents supporting the sheriff whether or not they agreed with him. "Honestly, I think we have our rights to carry guns," Justin Juhan told Rozzi, adding that there should be more focus on mental health than gun control to prevent tragedies like mass shootings. Former school teacher Vivian Murphy told Rozzi that she is for gun control. "I would like to see some of the big automatic weapons somehow be restricted so that we can protect not only children but people in public places," she said. But Murphy, who said she knows Garrison personally, said she admires him for standing up for what he believes. "I think Roger Garrison is doing what he can to uphold the Constitution, so I admire him for that," Murphy said.

Franklin County, Indiana Passes 2nd Amendment Preservation Ordinance – Tenth Amendment Center Blog While a number of states are currently considering legislation to nullify federal gun laws, rules, acts, orders and regulations, and various sheriffs around the country are issuing notice that they will not enforce any such federal laws, a new grassroots undercurrent could be building to support those efforts: local governments nullifying unconstitutional federal acts that violate the 2nd Amendment. Last week, Beaufort County, North Carolina became the first in the country to do so. On Tuesday, Franklin County, Indiana joined them by passing a 2nd Amendment Preservation Ordinance. It passed unanimously, and County Commissioner Scott M. McDonough says they mean business. “The citizens of Franklin County take the Constitution seriously and the State and Federal government need to do so as well,” he said. The ordinance itself is an extremely strong stand in support of the 2nd Amendment. It reads, in part: All federal acts, laws, orders, rules or regulations regarding firearms are a violation of the 2nd Amendment The ordinance continues: The Franklin County Board of Commissioners declares that all federal acts, laws, orders, rules, regulations – past, present or future – in violation of the 2nd Amendment to the Constitution of the United States are not authorized by the Constitution of the United States and violate its true meaning and intent as given by the Founders and Ratifiers; and are hereby declared to be invalid in this county, shall not be recognized by this county, are specifically rejected by this county, and shall be considered null and void and of no effect in this county. Recognizing that federal acts almost always require support, logistics and the like from state or local governments, the final portion of the bill is what would give it the most effect in helping protect the rights of the people living there: It shall be the duty of the Sheriff of this County to take all measures as may be necessary to prevent the enforcement of any federal acts, laws, orders, rules, or regulations in violation of the 2nd Amendment to the Constitution of the United States. (AP) — Mississippi defied the union during the Civil War and civil rights era, and at least two lawmakers think it is time to do so again. Republican state Reps. Gary Chism and Jeff Smith, both of Columbus, filed a bill this month to form the Joint Legislative Committee on the Neutralization of Federal Laws. Chism said Thursday that the tea party-backed measure is a response to President Barack Obama's federal health care overhaul and proposals to curb gun violence. "Certainly, the Obamacare started this," Chism told The Associated Press, referring to the health care plan, "but then gun show loopholes that the president wanted after Newtown really put an exclamation on that — that we need to do something to stand up for the Tenth Amendment." The Tenth Amendment to the U.S. Constitution says powers not specifically reserved for the federal government are reserved for the states. House Constitution Committee Chairman Scott DeLano, R-Biloxi, said the bill has a good chance of being debated and that he has heard from other lawmakers who support it. But Mississippi College constitutional law professor Matt Steffey said the measure is a waste of time because federal law trumps state law when the two are in conflict. "It is hard to imagine a less productive use of time by key legislative officials than to pursue that which they have no power to pursue," Steffey said. Republican Gov. Phil Bryant last week asked legislators to block enforcement of "any unconstitutional order" from Obama regarding guns. Mississippi has resisted federal laws as far back as the Civil War and during the civil rights era. During the 1950s and '60s, a state agency called the Sovereignty Commission spied on people believed to be sympathetic to racial equality. The agency was dismantled in the late 1970s. Some critics compare the proposal by Chism and Smith to an attempt to rekindle the Sovereignty Commission. "It's absolutely the most horrendous idea that has ever come before this august body," said Rep. Steve Holland, D-Plantersville. "It's awful. It is wrongheaded. It is anti-New Testament. It is political fodder for the right and borderline stupid." Rep. Kelvin Buck, D-Holly Springs, a member of the Legislative Black Caucus, said he sees the bill as part of a trend of defiance toward federal authority. "I think much of it is because we have an African-American president," Buck said. "I think it is outrageous," Buck said. "In my view, it is taking us back to the pre-civil rights era." Chism said the bill is not an attempt to roll back civil rights advances. He also said it is not an attempt to revive the Sovereignty Commission. "That was an ugly past," he said. "It ain't got nothing to do with that." Smith did not immediately return messages seeking comment. The Central Mississippi Tea Party said in a news release in December that it wants state lawmakers this year to "re-establish limited federal involvement in Mississippi."

The House voted in favor of a bill that would seek to block the federal government from restricting assault weapons and high-capacity magazines. It amended the bill to specify that federal officials who tried to enforce any ban would be subject to state misdemeanor charges instead of felony charges. President Barack Obama has called for reinstituting a federal assault weapons ban following the massacre of 20 Connecticut first-graders by a gunman last month. The House on Wednesday also gave preliminary approval to a bill that would allow citizens who hold concealed carry permits to carry guns on campuses of public schools, colleges and the University of Wyoming. Kendell Kroeker, R-Evansville, sponsored the bill to exempt assault rifles and magazines from federal control. Rep. Mary Throne, a Democrat and attorney in Cheyenne, said some states have tried such nullification laws in the past. She said such efforts were common in the years before the civil war and then during the civil rights movement, when some segregationist states tried to ignore federal law and practice nullification of federal laws. “If we want to make a statement we can do it, but let’s not let’s not pretend that it’s consistent with the Constitution, because it’s not,” Throne said. The non-partisan Legislative Service Office has issued a legal analysis of Kroeker’s bill that notes the U.S. Supreme Court recognizes federal laws as the supreme law of the land. Rep. Allen Jaggi, R-Lyman, sponsored the bill to allow people who hold state-issued concealed carry permits to carry guns on school campuses. A retired teacher, he said he worries about the safety of schools in the state, noting that they’re currently classified as gun-free zones under state law. “Most of the horrific accidents that we’ve heard about have happened in gun-free zones, and the bad guys really don’t care what the laws are,” Jaggi said. “I’m a law-abiding guy, and if that’s the law, I won’t carry where I’m not supposed to carry. But the bad guys don’t have that thought, they just want to do whatever they want to do.” Rep. Jerry Paxton, R-Encampment, said that as a former school principal he had serious concerns about the including elementary and secondary school provision in this bill. “I certainly don’t want to get into a situation where we’re creating a killing field inside of a school, but I think this bill creates the opportunity for many, many different things that could happen that would endanger kids.” Paxton said he could see where a student could get ahold of a firearm inadvertently if a teacher forgot to lock a drawer. Rep. Stephen Watt, R-Rock Springs, said school administrators don’t currently know if guns are coming into their schools or who has them. “Someone who wants to bring a gun into a school will do it, and if they want to use it for evil, they’ll use it for evil,” Watt said. “It’s that simple.” Chris Boswell, lobbyist for the University of Wyoming, said after the House vote that the university administration is concerned about the prospect of losing its authority to maintain its current policy of prohibiting students from carrying weapons either openly or concealed. “I believe the trustees, through the regulation, have indicated that the risks may outweigh the benefits of allowing guns to be carried on the university campus,” Boswell said, adding that the university has a police force.
South Dakota House passes bill allowing school districts to arm teachers | Fox News A bill that would allow school districts to arm teachers and other personnel with guns was approved Tuesday by the South Dakota House after supporters said it could make would-be attackers think twice about entering a school building. Representatives voted 42-17 to send the measure to the Senate for further debate. Supporters said school boards, particularly in rural areas where no law enforcement officers are stationed in school buildings, need the option of arming teachers, administrators or volunteers to protect against attacks like last month's school shooting in Connecticut. Opponents countered that arming teachers could make schools more dangerous because it could lead to accidental shootings and put guns in the hands of people who are trained to teach, not shoot people. The bill's main sponsor, Rep. Scott Craig, R-Rapid City, said the measure leaves it up to each school board to decide whether to train and arm teachers and others. Schools are now inviting targets for potential mass murderers because they are considered gun-free zones, he said. "The possibility of an armed presence in any of our schools is a deterrent," Craig said. Rep. Ray Ring, D-Vermillion, said he opposes arming school personnel because it's more likely to lead to accidental shootings than to stopping attackers. He noted that associations representing local school boards, school administrators and teachers oppose the bill. "Educators believe arming teachers and volunteers with minimal training will erode the learning environment without significantly improving security," Ring said. Supporters argued the bill would require that anyone taking part in a so-called School Sentinel program complete training that would be designed by the same commission that sets training standards for law enforcement officers. Local law enforcement agencies also would have to approve such a program, and school employees could not be forced to take part. Rep. Steve Hickey, R-Sioux Falls, said arming school personnel in some districts is only part of an overall approach to school safety. Some schools need to make their entrances more secure, and more mental health counseling is needed for students, he said. Rep. Troy Heinert, D-Mission, said he doesn't want his son in kindergarten to think about his teacher being armed. "Doesn't this bill blur the line between a teacher and a law enforcement officer?" Heinert said. "Do we want to tell our children the only way to be safe is to carry a gun?" Rep. Stace Nelson, R-Fulton, said educators are trusted to teach students, so they also can be trusted to protect students from harm. Nelson, a retired law enforcement officer, said teachers can be trained to handle guns safely and effectively.
