(Rifles "borrowed" from a local FFL bypassing Federal Statutes, for which NO ONE was prosecuted) Remember when Uncle Billy, gave every two bit Cop Shop M16s for free, under some "Military Surplus" deal, to rid the Army of these extra inventory. That allowed the Army to purchase the modern later versions they are now getting ready to surplus, today. Did you ever wonder where all those FULLAUTO Weapons ended up? I can assure they are NOT in the Cop Shops Weapons Lockers. Many were scrapped, as they were junk from the Army. Some just never appeared on the inventory, after a few years., and a lot are in closets of reTired LEOs, and again Off- the-Books. This is just how things were DONE, back then, and it still continues today, in many Departments. Especially in NFA States. As these Old Boys die off where do you think these weapons will be going to? Certainly NOT to families, because they are NOT Listed on the NFA Registry, and possession is a Federal Felony, for which a reTired LEO, can find some friends to keep out of trouble, but the wife or kids will have no such protection. Over the years, I have been involved in repatriating some of these weapons from the hiding places, by widows of LEOs. It gets really sticky, depending on who the ATF Guy you deal with is. Some of these LEOs think they are above the Law, in these cases, and get quite arrogant when they are confronted, with the Federal Statutes. Lots of rationalizations get given, and lots of BS GETS SPREAD. Usually it gets swept under the table as no one really wants to open this Can of Worms. This is the reality of the issue. ........

Yeah, I remember the loaners. If I recall correctly, the loaners aren't supposed to be modified in any permanent manner. Hence why departments are dropping big $$ on SA variants. It turns out that most people are hard pressed to use an M16A1s inside a building. It was certainly a knee-jerk reaction.

I can imagine the attitudes of the cops on those weapons. Its a problem waiting to happen. If you will remember when Drew Petersen was arrested, in his house an SBR was found. Since he was no longer an LEO, the letterhead that he possessed it on was no longer valid. That was never charged to my knowledge, but it does show either the arrogance or ignorance to the laws that we all have to follow. That's not ok in my book.

A lot of the locals here can purchase their own patrol carbines, and do. Most are purchasing 16" SA carbines.

It was more than just rattle-trap M16s given to LEO departments. My local SD was given (or bought cheap) three ex-USAF Cadillac-Gage Security APCs. One still sits out back of the jail, rusting slowly away - the other two are gone. To my knowledge, they were NEVER actually used in any way. At least their little SD-marked VW bug sees parade duty.......
At the time, our Sheriff, Ken Katsaris, was an ex-FBi guy with bigger ideas than his budget allowed. He replaced our SD cars with under-powered overly-comfy Fords that couldn't get out of their own way - the Deputies hated them, as they were useless in high-speed pursuit. Nice for sitting in the donutshop parking lot though.......
He did replace the ancient Bell 47G bubbletop helo with a JetRanger though. It took a lot of time and effort for the local A&P tech school to keep that old 47G in flyable condition.

Great Article, and as always with a relatively easy question. The answer is extremely complex.

At the extreme end of the spectrum, I'd say that Martial Law would be a flag. When ones constitutional rights are suspended, logic suggests that ones responsibilities can be questioned as well. Including that of adhering to the rule of law.

Anything short of that is a case by case / facts based proposition.

I'd like to say this thread is a breath of fresh air. 99% of every forum I've been on will not allow this subject. I'm liking this place a lot more now.

As for the subject itself, When I served my country I happened to pull guard duty on the wrong night in the wrong place so I know what I am capable of.
